Places to Sign Recall Petitions - Tholen/Omeish/Cohen

In any event, Hingeley, the Commonwealth’s Attorney who took over the case after Steve Descano recused himself, turned out to have just as significant a conflict of interest as Descano. He should have declined the assignment, and both his failure to do so and Tholen’s acquiescence in the charade stink. She is utterly tainted at this point.

Tholen did not pick the CA. I think she is lousy and won't vote for her, but this is a waste of time. But more money for lawyers, so there's that.

Maybe not, but she went along for the ride and declared herself exonerated when a CA she should have known also had a conflict declined to present evidence to the judge. What a scam.

Tholen donated $2,344 to Descano, according to Descano's campaing contribution list (please see vpap.org) so he recused himself, turning this to James Hingeley, who, not surprisingly, determined that tholen did indeed do her job.

Descano and Jim are both happy recipients of funding from the Justice and Safety PAC (Descano received $601369 (vpap.org) and Jim $5,000. This is one of the PACs that sends money into local elections to tilt results in favor of far-left democrats.

Hmmm - I wanted schools to open and was mildly in favor of Open FCPS and supported bu-partisanship but now all I see is vindictive Republican out to get people who were elected but did not vote the way they wanted them to vote. And (BTW) there was at least 40% of parents who wanted virtual.

That is fine - but for the record, Im a democrat, voted for Elaine, wanted schools to open, and signed the petition to recall her. So there is actually a bi-partisian element to this effort.

I don't think Elaine will run again or could win if she were to do so. She doesn't exactly look like she's having the time of her life on the SB anyway.

Did a little research on the Motion to Reconsider filed last Friday by these folks.

It runs out that in Va. a Motion to Reconsider can only rely on facts and documents that were evidence in trial? This seems like they are trying to introduce new "facts".

"A motion to reconsider is not the time to raise new evidence, especially if you could have gotten that evidence during trial."

That seems a bit like a Catch-22, if true, because the allegation here is that Hingeley’s conflict of interest is what prevented the matter from even going to trial.

It doesn’t reflect well on Tholen, Descano, or Hingeley in any event, especially given Tholen’s reputation for cutting deals behind closed doors.

I just hope she announces sooner rather than later that she will not run again

It's not a "seems a bit like" - it's the law.

Do they even have a lawyer who understands how the law works in VA?

If they do they should not be paying this person because they have failed them at every meaningful step in the process...

You seem kind of dense if you don’t realize they could lose a legal battle and still win a political war.

The analogy would be other special elections Republicans are winning in states less blue than California.

Its too bad that elaine's political safety net saved her, but she is through come election time. Im not making the mistake of voting for her again, and Im guessing there are many more like me.

she never wanted to run in the first place. She entered the race after the first person backed out.

No need to guess.
