Did a little research on the Motion to Reconsider filed last Friday by these folks. It runs out that in Va. a Motion to Reconsider can only rely on facts and documents that were evidence in trial? This seems like they are trying to introduce new "facts". from https://thelawisyourfriend.blogspot.com/2014/08/getting-second-chance-in-virginia.html "A motion to reconsider is not the time to raise new evidence, especially if you could have gotten that evidence during trial."
That seems a bit like a Catch-22, if true, because the allegation here is that Hingeley’s conflict of interest is what prevented the matter from even going to trial. It doesn’t reflect well on Tholen, Descano, or Hingeley in any event, especially given Tholen’s reputation for cutting deals behind closed doors.
It's not a "seems a bit like" - it's the law. Do they even have a lawyer who understands how the law works in VA? If they do they should not be paying this person because they have failed them at every meaningful step in the process...
You seem kind of dense if you don’t realize they could lose a legal battle and still win a political war.
