Homeless Man Killed by Fellow Passenger on NYC Subway

Anonymous
I’m familiar with Daniel Penny’s lawyers at the firm Raiser Kenniff. Even though I have nothing against either Raiser or Kenniff, Daniel Penny’s odds of prevailing at trial (I think he deserves to walk) went down precipitously when he hired them.

Regardless of what they claim on their website (I haven’t checked), Raiser Kenniff’s specialty is DUIs and running for office to promote conservative causes. They are NOT trial litigators and they are completely in over their heads in this high-profile criminal case.

They’re already mismanaging the case with that terrible statement they released and the subsequent blurbs. If anyone can lead this man to an undeserved prison sentence, it’s Raiser Kenniff. I just hope they know enough to bring on competent trial counsel once it’s time for voir dire.

More than most cases, this case will come down to the jury. If they empanel a jury made mostly of middle aged and older NYers who actually take the subway, rather than these foolish “progressives” who think it’s cute to get pushed onto train tracks, then Mr. Penny walks.

If I had a weapon, I would have used it. He could have easily killed me. I am very ill and it would not take much from a lunatic homeless vagrant to kill me. Sorry, I'm not dying for these people, they have already taken enough from me.

But he didn't kill you did he? And if you had a weapon you would most likely have killed a man for no reason other than that you were scared.

People are allowed to defend themselves when attacked. Someday you'll learn that life is fleeting easy to extinguish, and those of us going about our business are tired of being bullied and hurt by people like you.

Uh, there is nothing to indicate that PP is violent. You, on the other hand, seem to have a hair-trigger impulse towards it.

Justice does not need to be violent. You, on the other hand, are excusing any violence short of murder, which is despicable.

Cite the witness statement that shows he was violent on the train the day he was killed.

There were multiple 911 calls before Penny rook him in a chokehold.

How often do you think New Yorkers call 911 on the subway about nonviolent people?

Those calls did not indicate violence, just fear, racism, and classism.

There are homeless people and Black people and Black homeless people on the subway all the time. Racism and classism were not what was happening on that train.

Good. He has excellent legal counsel.

Excellent legal counsel wouldn’t be suggesting he give interviews like this.

There was nothing wrong with that interview.

You’re an actual idiot. No, those calls did not indicate “racism and classism.” I know this because I take that exact line and am in that station often. Trust and believe that 911 calls are exceedingly rare. You don’t have one clue what you’re talking about.

He's trying to be sincere. He's not a politician or attorney or PR guy.

I take it multiple times a week and PP saying the calls indicated “racism and classism” is hopelessly full of sh!t. Multiple passengers in a single car calling 911 is exceedingly rare. We’ll see what witness testimony brings to bear, but this was not a “normal encounter with a homeless man.” We can all be pretty sure of that.

When a person has a history of violence and is threatening violence, are passengers supposed to sit there and hope they won't be assaulted?

PP here. "Bullied and hurt by people like you". That's a joke right? I've never been arrested in my life and my only problems with the police is getting two driving tickets.

Your type of irrational logic is why I think many people shouldn't be allowed to have guns or carry them in public. I can only imagine the amount of times that you would reach for your weapon every time you were upset about something.
