The medical examiner actually didn't even wait for the toxicology report. If you see someone get choked for several minutes, past the point of being unconscious, it doesn't take a rocket scientist to figure out what caused his death. Could other factors contributed to his death? Sure. |
What about the evidence (not introduced at trial) that he was alive when the EMTs arrived and they refused to treat him because he was so unsavory? |
Are you talking about reports of the homeless guy having a faint pulse? He was obviously swirling the drain at that point. It would be strong evidence if he was conscious and breathing after the encounter and then later died at the hospital, but that isn't what happened. |
