Recurrent nuisance noise problem with neighbor--what to do?

Either it's legal or it's not. Call police at 3am and have them register the decibels emitted by the activity. If it is past the county ordinance then they will be cited. If it is within allowable limits, shut up and deal.

Right, but the other issue is that our HOA has much stricter noise ordinance limits than the county. However, our ineffective HOA president is too wishy washy to enforce the HOA covenant (not just about this but about other issues in the neighborhood that we have heard about). So how does one deal with that?

Well, OP, you really have to call the police. I don't know where you live, but where I live in Bethesda, I can call police for noise violations after 9pm. Please do that each and every time. They've had their chance.

Why do I sound awful? If I'm paying high HOA dues every year to live in this neighborhood, which don't go towards anything tangible that I have been able to see, then I would like for the HOA president to actually address issues that need addressing.

You sound like a whiny, unreasonable asshole of a neighbor. Maybe they are doing it just to piss you off because you complain so much and feel compelled to tell them what they can and can't do. Perhaps the HOA president won't step in because you have no case.


Well they are in violation of the HOA noise ordinance, so it's not me telling them what they can and cannot do. It's the HOA covenant that is saying they cannot do this. Also they are in violation of county noise ordinances because this is 24/7. I have recordings of the noise timestamped at 3 in the morning. There is no question that that is unreasonable.


Sue the HOA, HOA president and the neighbor, jointly and severally. That'll bring all parties to the table.

I understand, OP. I would call the HOA President and tell him that if he won't take care of it, you will call the police. We live in a strict HOA controlled neighborhood. But our association doesn't mess around. Example - A few weeks ago my neighbor parked his boat in front of his house. You can have it on the street for 24 hours. No one complained. The might have had it in the street six or seven hours too long (not even a full day). They were hit with s $250 fine. I got a warning note because one of the numbers on my mailbox was crooked and loose. Annoying, but worth it to avoid exactly what you are dealing with. Your HOA needs to step up.

OP, there are laws about noise that supersede the HOA bylaws. Call the police.

But if you're the only one hearing it you may get that 5150.

Your HOA Prez sounds like a wimp. My advice is to join the HOA board and instill some discipline. In the meantime, you may need to hire an attorney to send a letter to the HOA and neighbor, giving each one more chance to address the issue. If they continue to violate, you'll file in local court.

And yes, you sound whiny. I doubt your baby really gives two shits about the noise.
