You can certainly make that argument, but it wouldn't be clear cut at all. The law is probably not limited to affiliation to a political party and, even what is considered a party would not be limited to R/D. And, while you would argue it was because of militia membership, they could just as easily frame it differently as tied to conservative viewpoints or even in groups that, while repugnant, couldn't reasonably be called a militia.

So you can either not offer your place for rent at all, or offer it. You can't discriminate based on the renter's political views.

That's why the Harrington Hotel (and Harry's Bar) just decided to shut down last week.

DC is asking people not to come to town for the inauguration this year. If I owned an AirBnB, I would not rent it out at all.

If you have fewer than 4 units, you are exempt from housing discrimination laws. I'm okay saying that I don't rent to Nazis.

The National Guard is a militia. The cosplayers with guns aren't a militia, they're terrorists.

I would LOVE for someone to come challenge me for this. I have bottomless money for this fight, especially after this week. Nazis are garbage. Sorry, no room at the inn.

AirBNB is now saying they will not allow rentals for Inauguration for people who are coming to participate in the riots. But I imagine that’s not going to be that effective since most people won’t say they’re coming for the riots. I really hope landlords do the right thing here.
