You can certainly make that argument, but it wouldn't be clear cut at all.  The law is probably not limited to affiliation to a political party and, even what is considered a party would not be limited to R/D.  And, while you would argue it was because of militia membership, they could just as easily frame it differently as tied to conservative viewpoints or even in groups that, while repugnant, couldn't reasonably be called a militia.[/quote]
