Only if the author of the article explicitly allows distribution of his intellectual property in that manner. DCUM respects intellectual property rights and will delete articles that appear to have been posted in violation of copyright laws. The appropriate means of bringing article to DCUM readers' attention is to post a brief summary or excerpt and a link to the original source.
Just curious, but how is posting an article in full so it can then be discussed on a DCUM thread a violation of copyright law? Assuming no one here is posting claiming it is their own… Can’t imagine that would happen as the poster would be identifying themselves.
Posting an article to discuss would seem to be clear ‘criticism and commentary’ which is not a copyright violation. Has DCUM received DMCA take down notices for articles?
We have never received a DMCA take down notice, probably because we proactively remove obvious copyright violations. "Criticism and commentary" is a factor that weighs in favor of fair use, but does not provide for complete copyright relief. The amount of the copyrighted work used is another factor. The more of a work that is used, the more likely that the commercial damage is to outweigh the necessity of the need.
In other words, If someone says, "I can't read the article because of the paywall, can you post it's text" and another poster complies, there is an obvious commercial factor that weighs against fair use. If use of the work is necessary for legitimate criticism and commentary, that can likely be done with limited use of the material. The line delineating fair use is almost always gray and, like the previous poster suggests, I don't have an interest in hashing such things out in court. I'd rather just have a fairly simple rule that everyone can follow.
