There was no lack of due process. Mom had a valid deportation order. She took her own child who is as a citizen allowed to return. A man claiming to be the father was unwilling to provide proof of identity to ICE agents. The end. |

The child's custodian indicated that there was an issue with taking the child out. The determination as to whether the child could therefore be sent overseas was a live controversy and it should have been resolved before the child was sent anywhere. That's your due process problem. I know it's tough for those of you with single-digit IQ's or blinding devotion to Trump, but I have faith you can overcome your disabilities. |

Yes we know what the judge said. Judges can be dumb (see the judge arrested for secreting a criminal illegal alien out her back door in the courthouse to evade arrest). Everything I’ve said too has been linked to news articles in this thread as well. No one is confused that this was an American citizen toddler. But she was also with her legal mother who wanted the child with her. We aren’t going to be like Obama and take children from their immigrant parents. Sorry. |
Silly argument. Like, really silly. Yes it’s annoying to get the paperwork for a passport but all parents who want one have to go through the same process. As for trauma, it would have been much more horrifying for the toddler to be wrenched away from her mom and put into foster care (since her dad refused to come forward). |

No, the govt presented a statement they said was from the mother, who did not testify, but the father would have an equal right to prevent her from being taken out of the country. There's a lot of law developed for this because of US citizens who have a child with a foreign national, they break up, the foreign national wants to take the child to their own country of origin. |
No evidence he was a terrorist or a gang member, only Venezuelan. The judge's daughter let him live in a casita on her property (basically a guest house but the one's I'm familiar with are small and basic), the daughter (and perhaps the whole family) is into guns and shooting and she let the guy handle and shoot her guns. Which turns out is a felony if you are not an authorized immigrant, which she should have known--the photos I've seen did not show the judge and the Venezuelan guy together with guns--and should not have allowed, although a pretty benign version of the law regarding unlawful "possession" of firearms (eg a felon can't live in the same house with a gun unless the right to own a gun has been restored). I don't think he's been charged, but he did resign. |
