Judge with many pro-Trump rulings has condemned Trump/ICE
for violating the Constitution in deporting a 2-year-old US ctizen, refusing her access to a lawyer, and refusing to allow her to appear in Court as summoned.

They won't stop at 2 year olds. Judges, members of congress, "agitators" - everyone is fair game to be "disappeared" by this administration.

At a minimum, the mom and sister cannot be deported until there is a custody hearing for the US citizen child. They didn't actually check to see whether both parents want the kid to go to Honduras or if there is a custody agreement in place that the kid must live in the US.

The child wasn’t deported. A US citizen cannot be deported. The illegal alien mother was deported and chose to bring her child back to her country with her. She put in writing that she wished to have the child return with her to her country.

Nonsense. This was a girl who went with her mother and was her mother’s right. The child has every right to re enter the US. A citizen can’t be deported and wasn’t.

Are Dems for family separation now?

Reuters: “prosecutors said Villela, who has legal custody, told ICE that she wanted to retain custody of the girl and have her go with her to Honduras.”

The man claiming to be dad was asked to present himself to ICE but refused to do so.

Read the complaint. The mother and sister had deportation orders. The father is in the country illegally as well. That’s why he did not take custody of the citizen child, as he was told he would be detained and deported as well. Regardless, the child has every ability to return to the country. The parents only have to arrange transportation for her to return. It was the mother who wrote that she wished for her daughter to return to Honduras with her.

I think the courts do not feel they can trust ICE’s word, and they can’t exclude the possibility of coercion on the part of ICE, or to follow due process.

“Trump administration officials said in court that the mother told ICE officials that she wished to take V.M.L. with her to Honduras. The filing included a handwritten note in Spanish they claimed was written by the mother and confirmed her intent. But the judge said he had hoped to verify that information.”

I think ICE feels like they can’t trust the judiciary after one judge was just arrested for obstructing a legal arrest.

Works both ways.

I read the complaint. Father wanted child to be taken by guardian Trisha Mack. ICE wouldn’t allow it, they were using the child to get father to present himself and be deported.

They should pick up the dad too so they can be reunited.

This is a no win. If they left the child here against the mother's wishes, they would be called cruel for separating the family. Instead media is running with the headline that a US citizen was deported.

The child can return. Anyone claiming she was deported and insinuates she can't come back is a liar.
