The mom had custody.


Physical custody does not mean absolute legal custody. Look at the divorced parents who are not allowed to move out of the state because the non-custodial parent would have to travel to see the child.

I haven't read the whole thread, so apologies if this has already been covered, but exactly how does a US citizen leave the country without a passport? My toddler had to have a passport to leave and to come back.

No, the govt presented a statement they said was from the mother, who did not testify, but the father would have an equal right to prevent her from being taken out of the country. There's a lot of law developed for this because of US citizens who have a child with a foreign national, they break up, the foreign national wants to take the child to their own country of origin.

The father is here illegally too and has a deportation order. He refused to come pick up the child because he didn't want to be deported.

"21. Roughly an hour after V.M.L.’s mother and the girls went into the ISAP office, V.M.L.’s father, who had taken them to the appointment, received a call from a person inside the ISAP office. That person said the family had all been taken to the immigration office and gave him an address. When he arrived at the address, he saw that it was the ICE Field Office in New Orleans at 1250 Poydras St, Suite 350, New Orleans, LA 70113. ICE officers took him outside and gave V.M.L.’s father a paper saying that V.M.L.’s mother was under their custody. The ICE officers said they could not give him any more information but that V.M.L.’s mom would call him soon.""

This occurred on the morning of April 22.2025. Go read the whole complaint. ICE will lose this one too.

The crux of this story is that this particular deportation--like so many others we have already read about--appeared to be rushed and did not follow a "meaningful process" (judge's words). The judge--by all accounts a pro-Trump judge who has come through for Trump in the past--was concerned enough about the lack of a "meaningful process" that he scheduled a hearing for May 16 to follow up on this matter. Sounds like another "oopsie it's too late" removal.

Lose what? There are no charges here. The mom was properly deported and there is nothing to prevent the child from returning as the government has pointed out.

It’s convenient you are leaving out what happened over the next two days including the request for him to return to the ICE office which he refused to do, knowing he would also be held for deportation, and asking instead to release his daughter to a non related “custodian.”

How can a child return without a passport, SSN card or Birth Certificate. I doubt this mom was had the time or opportunity to collect any of her kids documents given the speed of this deportation. ICE is not following the law and they are even claiming now that they can enter peoples homes without a warrant.

How do you know she doesn’t have those things?

It’s not our problem if this family now has to go through the hassle of getting her papers just like any other parent has to.

ICE didn’t break any law. The mother wanted her daughter to go to Honduras and had custody.
