The fact of the matter is that race and gender are factors here. They simply are. And someone as intelligent as Gorsuch knows it, which makes it all the more shameful.

So, is being a nutjob a requirement to be a libertarian? Rand Paul and Gorsuch both seem to be nutjobs. If he is such a big man, then Gorsuch should volunteer to work in a Covid ward maskless 8 hours a day for 40 hours and go home each day and not wear mask at home. Will he survive then? Can he be impartial in his judgments or will he declare his libertarian thinking cloud his decisions? Can we trust his decisions to be impartial and only based on the facts presented in a case before him?

That's a classic non-denial, denial. Totenberg didn't report that Sotomayor asked Gorsuch. What she reported was:

Sotomayor did not feel safe in close proximity to people who were unmasked. Chief Justice John Roberts, understanding that, in some form or other asked the other justices to mask up. They all did except Gorsuch, who, as it happens, sits next to Sotomayor on the bench.

If there’s not even a kernel of truth to the story, Gorsuch can put this all to rest by publicly stating that he will happily don a mask in the workplace, should such a request be made.

He doesn’t even have to make a public apology statement; he can just start wearing a mask when he sits next to his colleagues like he was asked. We will see what he does when they next sit.
