Roberts should send Gorsuch home to do Zoom Court until he wears a mask.
Or whoever is on the other side of the dais should offer to switch seats with Sotomayor. Or Roberts should reorder the seating. Lots of ways to handle this OTHER than Sotomayor having to be at home. What isn't being reported is whether those other options were considered at all. |

It would be better than them sitting right next to each other, but with omicron, it wouldn't mitigate the risk enough. It's also not just during oral arguments. When the justices meet in conference, they are presumably in a room sized appropriately for a group that size. Sotomayor also attended conference via Zoom as well. |

The seats are by seniority. Moving her would either require her to take a less senior seat or for a more senior Justice to do so. |

Just heard a report on this story on Fox News. Shannon Bream is their SCOTUS reporter....
She said her sources at SCOTUS said.... "It is not accurate. There has been no blanket admonition or request from Chief Justice Roberts that the other Justices begin wearing masks to arguments. The source further stated Justice Sotomayor did not make any such request to Justice Gorsuch. Given that fact, there was also no refusal by Justice Gorsuch." I don't expect the nay-sayers here to believe this. Given how this rumor has spread (compliments of an uninformed NPR reporter), I would also anticipate an official statement about this story would soon come from SCOTUS. |
