He let us file a police report and said that he needed a signature but when we came back for that he said he would not have probable cause.

op, I know someone whose son engaged in consensual hooking up with his girlfriend. both the girlfriend and her parents agree it was consensual and have not pressed charges. the same thing happened a year ago and the school is making the boy go to an alternative school for the rest of the school year. both sets of parents were shown the video.

ask to see the video. subtly take out your camera and video it while they are showing it to you.

No one is family with him. He was shortly suspended for a few days but that was all. I saw it but they would not let me have it.


This seems appropriate. A suspension is a big deal. What do you want to happen?


He's regularly suspended and has been suspended three times since. I need proper justice.

Deal with one thing at a time OP. File the police report. Depending on who your SRO reports to, you can then make a complaint about the refusal of filing the report. Find your daughter a therapist. Those should be the 3 things to deal with now.


OP here - With filing the report, Will they get the video from the school or expect me to have it? Is video really the main evidence used in cases like this or can I file a report and charges without it (if it's lost or deleted) and get accountability.


They will get the video. There are steps you can take to get the video too and you should do that as well. You don't need the video to file the report. You don't need anything other than your daughter and her telling them what happened. They follow up on everything else. Unless there are witnesses, the video will be the main evidence.

You’ve never dealt with the criminal justice system. There won’t be any evidence or investigation. Cops don’t have time to investigate violent crime, no one is investigating a light touch of the thigh. OP can try to file a report, the cops aren’t going to write a report for someone touching a thigh. OP’s kid is going to leave the police station feeling stupid.

Also—the kid was already suspended. What else does OP want? Jail time? Probation? Fines? None of that will happen.

This. You may also want to consider some kind of self defense course or assertiveness coaching in addition to therapy. Someone touching her thigh without permission is not okay, but being able to say “take your hand off me” and mean it is very empowering (and effective most of the time).

File a FOIA request for the video. If they turn that down, get a lawyer and file a complaint, which will allow you to subpeona it.

Plot twist it is actually DS that was assaulted and girl put a hand on his thigh for a few seconds. Police won't take a SA report because a boy is reporting it.
