Can you get a restraining order to keep him away from her that would keep him from riding the bus?

If it's possible to get that, I would try for it.

You may not be able to achieve that because it might be the only way he can get to school.

But it's worth checking into.

He let us file a police report and said that he needed a signature but when we came back for that he said he would not have probable cause.

op, I know someone whose son engaged in consensual hooking up with his girlfriend. both the girlfriend and her parents agree it was consensual and have not pressed charges. the same thing happened a year ago and the school is making the boy go to an alternative school for the rest of the school year. both sets of parents were shown the video.

ask to see the video. subtly take out your camera and video it while they are showing it to you.


No one is family with him. He was shortly suspended for a few days but that was all. I saw it but they would not let me have it.

How did the school handle? Did they punish the boy? Did an administrator discuss with you what was seen on video (even if she would not show you the video)?? Refer to school resource officer if there is one? Ours won’t show video to parents either, but will discuss what was seen on the video (in general terms).

I’d see an attorney.

OP here. He is the SRO, I do not have attorney and do not know where to go from here. Could I just file a report with another cop?

I was SA on public transportation. While the cop who took my report was very nice, he was also pretty honest about the reality of how far the case would get. And he was right, DA declined to prosecute. The evidence (a video) likely did not show enough to be able to charge him.

I also had a few people in my life comment stuff along the lines of "really, you filed a police report for that?". Because for some reason groping is now something that isn't a big deal.

Anyways, you can 100% file a police report. The reality is, the DA may not prosecute. Get a lawyer and see what your options are. A restraining order may be a good idea.

Yes. You just go down to police station with your daughter and file the police report.

The video was clear, I believe he just doesn't want to go through paper work and that stuff if the DA refuses to prosecute, but at least give us the right to file a report. It was a light touch for a few seconds on the thigh. He tried to gaslight us into saying it is not serious enough but I know if I filed it with another cop they most likely would let us. It's the video I worry about.

What are you worried about with the video? Just help her file the report. If the DA feels there is nothing to go forward with to prosecute, go from there. I'm the PP who was groped (hand up the skirt and touched quite roughly through my underwear). Ultimately, I just left it alone after that. Didn't feel like going through the headache of finding a lawyer and trying to push for something to happen.

After the report is filed, what is the process? is it automatically in all cases sent to prosecutors and they decide whether to charge him? They told me what I was signing was something to signify pressing charges, I did not know it was a report.

With the school, you usually can't dictate a punishment for the other kid. But you can ask how they will keep your kid safe. That may require expelling the other kid.

I do not have the video, the school does and since the Sro refuses to let us file a report along with the school admin, I don't know how to get it or if they might destroy it.
