Why did the SRO not feel there was probable cause to charge? I know you don’t want to give too many details probably, but was the video not clear/detailed enough? Or the offense was not considered serious enough?

The video was clear, I believe he just doesn't want to go through paper work and that stuff if the DA refuses to prosecute, but at least give us the right to file a report. It was a light touch for a few seconds on the thigh. He tried to gaslight us into saying it is not serious enough but I know if I filed it with another cop they most likely would let us. It's the video I worry about.

What are you worried about with the video? Just help her file the report. If the DA feels there is nothing to go forward with to prosecute, go from there. I'm the PP who was groped (hand up the skirt and touched quite roughly through my underwear). Ultimately, I just left it alone after that. Didn't feel like going through the headache of finding a lawyer and trying to push for something to happen.

Also, Sorry for what you went through. It's really tough for her, she has been missing a lot of school.

They've only dealt with the SRO. Who sounds lazy and the type who brushes smaller offenses off as "not a big deal". Op needs to go down to the police department.

That doesn’t make sense. Are you saying the cop wouldn’t write a report? Get a lawyer, file a police report. Only a prosecutor can keep you from pressing charges. They can decline to prosecute or strike a plea deal, but that’s different.

This is a question for the OP. OP, did the cops write a report and the DA refused the case? Can you explain further?

He let us file a police report and said that he needed a signature but when we came back for that he said he would not have probable cause.

did they at least say he's not allowed to ride the bus anymore??

op, I know someone whose son engaged in consensual hooking up with his girlfriend. both the girlfriend and her parents agree it was consensual and have not pressed charges. the same thing happened a year ago and the school is making the boy go to an alternative school for the rest of the school year. both sets of parents were shown the video.

ask to see the video. subtly take out your camera and video it while they are showing it to you.

No one is family with him. He was shortly suspended for a few days but that was all. I saw it but they would not let me have it.

This seems appropriate. A suspension is a big deal. What do you want to happen?

What state do you live in?
If you filed a police report on MD then you go to the commissioners office and file charges yourself. The Police don’t do that for you.
Take the report and file charges if you want to.
You can get bus footage through a FOIA request if you need to.

He's regularly suspended and has been suspended three times since. I need proper justice.

Here's the reality of what happened. I am not saying I agree with this, but I have a feeling this is what happened. The guy touched your daughter's thigh. You go to make report. SRO watches video. In his head "this isn't a big deal. The DA isn't going to press charges for him putting his hand on her thigh. I really don't want to have to do all this paperwork". You come to sign the report, he talks you out of it. School suspends kid.

You can go down to the police station and make another report. DA may still not prosecute but at least you can say you've filed the report.

My middle school son was assaulted walking home from school. The school assigned police officer was great. He flat out said I’m not going to be the officer who doesn’t follow up and then have a bigger issue occur. I don’t know that we pressed charges, but the officer filed something with the juvenile courts and they handled it. The school also punished the kid. The principal wanted to chalk this up to boys will be boys, which did not sit well wi the me.

I insisted to file it but he still refused. Are they allowed to do that?

OP here - With filing the report, Will they get the video from the school or expect me to have it? Is video really the main evidence used in cases like this or can I file a report and charges without it (if it's lost or deleted) and get accountability.
