It’s telling that Bragg chose not to present this to a Grand Jury. He knew he wouldn’t have gotten an indictment so he decided to bypass that process. If you aren’t confident in getting indictment what would make him think they will be able to get a conviction?

I completely disagree with charging the bodega worker and agree with charging the Marine. There is no way you can go after the store clerk and let this person go.

I have enjoyed reading the debate between the PPs regarding the issues of mentally ill, personal, societal and family responsibility.

He had a pretty established track record of assault. He landed at least one person in the hospital. People deserve better than waiting around for someone attacking and assaulting people to cross the line into murder. Neely was a disaster waiting to happen and here it is.

The failure of the NYC system is the clear cause of Neely's death. Charging the marine is just going to bring more spotlight to the helplessness of the city's court system and health system to deal with people with mental illness who are also violent. Or anyone else with mental illness, for that matter.

My understanding (from watching the video) is that the victim didn’t do anything of the sort. The person who was helping the accused responded to the bystander that there was there was an existing stain on the victim’s pants.

I doubt they’ll be able to get a unanimous verdict that the conduct was reckless, as opposed to just negligent.

This did NOT go to a Grand Jury. This was Alvin Bragg's decision.

I am one of the women who lives in NYC and takes the train frequently, and who objects on the basis of actual experience to people making light of the threat presented by unstable people on trains.

However: I do think charges are appropriate. I assume he won’t be charged with murder.


Same. We can’t just let someone kill someone else with literally no consequences.

Actually, the one that should be charged is Alvin Bragg for letting this guy off the hook so many times.

Neely pleaded guilty to felony assault Feb. 9 in exchange for a 15-month alternative-to-incarceration program, according to the Manhattan District Attorney's Office. He was supposed to stay in a treatment facility and abstain from drugs.

If he had completed the program, the felony assault would have been reduced to a misdemeanor, but he skipped a compliance court date and left the facility. A warrant was issued for his arrest on Feb. 23. It wasn't immediately clear how long he spent in jail awaiting the resolution of the assault case.

Court records show that as an adult Neely regularly lashed out at strangers on the subway and on the street.

From January 2020 to August 2021, he was arrested for public lewdness after pulling down his pants and exposing himself to a female stranger, misdemeanor assault for hitting a woman in the face, and criminal contempt for violating a restraining order. All three cases were dismissed as part of his Feb. 9 plea deal.
