I have to wonder why you think it is a politically winning argument to demand that the US bring Kilmar back for *a third time* to be processed and deported again. SCOTUS made their ruling based on the literal paperwork being wrong, not the substance of the deportation.

Besides. Kilmar is a citizen of Salvador and currently being held there on domestic charges. Seriously, who do we think we are to tell another nation they must give up a citizen of their nation to us?

Oh please. No one believes that El Salvador has “refused” to return him. Bukele is doing exactly what Trump wants him to do because he is being paid $8 million and it’s obvious that if the US really asked for him back we could easily get him back.

As the right wing judge on the 4th circuit put it, this case is just about the principle that you don’t get to illegally kidnap people from the US and then claim they lack any rights because they are outside the US.

That’s a laughable claim. He was never eligible for citizenship and that’s why his wife never tried to get him a green card. You can’t get citizenship when you enter illegally and he had already been denied asylum. Citizenship was never on the table.

You are correct that he was in legal limbo--undeportable to EL Salvador but no path to citizenship here. Not sure to resolve that.
But the fact remains, there was a legal order prohibiting sending him to EL Salvador and the Trump admin violated it.

Why no pass to citizenship? If his wife an American citizen, why would she not petition for him to obtain a green card and citizenship?

Just curious, would he be eligible for a green card if he has a criminal history of domestic abuse? If he gets a green card but then commits a crime, is his green card revoked? If he enters the country illegally, is he eligible for a green card?

No. Considering his record of domestic violence restraining orders, he will not be allowed to adjust his status to greencard holder; either as a matter of law or discretion.

His wife simply needs to move to El Salvador and hope for his release there, where they can live in peace in his country.

Are you at all familar with MS-13? They kill babies. I personally know one family whose daughter got wrapped up in MS-13 and they sent her back to El Salvador to keep her safe. But the gang made some calls back to the Homeland. They kidnapped her and cut her in half in the middle. Made her parents pay for each part of her.

Trump has said he is not even going to *ask*. Considering the fact there is a contract for the U.S. to pay El Salvador for imprisoning people I imagine there may be financial incentive to cooperate with this request.

Explain to me how you propose that Trump get Kilmar back from a sovereign nation who is refusing to comply, given that he's a citizen. We cant even get US citizens back from Hamas or Russia.
