Ok, 2 issues here: 1. They do not need a warrant to pull her over. IF they need probable cause, the car being driven by a known illegal citizen is enough. Once pulled over she must legally exit the car if ordered to do so. She did not. 2. Her car was not searched, so it’s a moot point. That being said, as above, you have probable cause to search because it’s currently being used in the commission of a crime, no warrant needed. |
That “phony asylum system” was created by congress and has been the law of the land for decades. It needs to be changed by congress. You can’t blame desperate people for using existing rules to stay in the country. The point still stands that at the time of the encounter with iCE agents in the video, she was legally here and had work authorization, whether you like it or not. We are a country of laws. |

As pointed out, you do not need a warrant to pull over a car, and once pulled over you do not have the right to disobey an order to get out of the vehicle. There is zero need for a warrant to remove her from the car. |
Pulling a car over is still considered a detention subject to the 4th ammendment. You do need probable cause of a crime or primary driving offense to pull over a car. What was the reason for the traffic stop? |
That actually is not correct. You need a primary offense to be pulled over. Immigration status itself isn’t such a thing. It’s not sufficient reason to conduct a Terry stop.
