WTF??? Is this legal??? https://www.cbsnews.com/baltimore/news/maryland-woman-arrest-ice-immigration-el-salvador-berrios/ I can't believe it. Watch the video. It's heartbreaking. Horrifying. I don't speak much Spanish, but it appears they didn't have a judicial warrant. OMG. This is our country????
I'm sure you'd all be cheering if it were a grandma who had walked into the Capitol Building being terrorized by the FBI. She refused to obey the orders of law enforcement and found out. When law enforcement tells you to get out of the car, there is no Constitutional right to refuse to obey them and sit in your car thinking your magic window shields you from following the instructions of law enforcement. She found out.
Not true. ICE does not have the same power as the police. They need a warrant signed by a judge and not one of their fake pretend warrants.
You do not need a warrant to search a vehicle.
Yes, you do need a warrant or direct probably cause: https://triallawyersmaryland.com/when-are-police-allowed-to-search-your-car-in-maryland/
Ok, 2 issues here: 1. They do not need a warrant to pull her over. IF they need probable cause, the car being driven by a known illegal citizen is enough. Once pulled over she must legally exit the car if ordered to do so. She did not. 2. Her car was not searched, so it’s a moot point. That being said, as above, you have probable cause to search because it’s currently being used in the commission of a crime, no warrant needed.
