The number of people here who don't understand the Fourth Amendment is astounding.

ICE agents can make warrantless arrests if there is PC to believe the arrestee is in violation of US immigration law AND there is PC to believe the person would escape before a warrant could be obtained. But ICE agents cannot enter homes and other private places without a warrant signed by a judge. An arrest warrant signed by a judge authorizes agent to go anywhere, including private homes, where the subject might reasonably be found, but it isn't necessary to effectuate an arrest on the street.

Mimms isn't really on point here. Mimms is about a situation where police recover physical evidence as a result of ordering someone out of a car. Law enforcement, including ICE, can use a substantial amount force, including breaking a car window, to conduct a lawful arrest.

According to the article, ICE visited her home twice before breaking the window of her car to disappear her. In none of the three instances did they have a warrant signed by a judge.

The fact they could not get a warrant after the first two times indicates to me they do not have evidence. Indeed, they have not yet presented any evidence she is in a gang.

PLUS: ICE kidnapped Kilmar Abrego Garcia. He is likely dead so they have kidnapped and possibly killed at least one person. I hold Trump and ICE responsible for Garcia's fate.

Trump thinks anyone with a tattoo is in a gang, so I would not pay attention to anything but real and solid evidence that has not been manufactured. They do not have evidence and they have not provided evidence.

No one objects to the government removing actual gang members, but they’re removing people with no evidence of gang membership and no due process. And that’s a problem for everyone in this country, citizen or not.

An article stating she was in a gang is not the same thing as evidence she was in a gang. I can't believe this needs to be explained.

I could write an article right now saying anyone here was in a gang. Does not make it true.

Sure. They just sent Kilmar Abrego Garcia to a prison and won't return him despite the Supreme Court of the US voting 9-0 that he needs to come back.

Yes, yes I do think it's quite possible that this woman--and many others--are being picked up by ICE on ZERO, bogus, or flimsy evidence. The Turkish student who was abducted off the street outside Boston is still in a Louisiana prison. She was picked up for co-authoring an op-ed in her college paper that was pro-Palestinian. I'd be happy to link it if you'd like to see it for yourself. It was not "radical" in any way. Regarding the Venezuelans sent to El Salvador:

"Many Venezuelans deported to El Salvador have been found to have no criminal record in the United States, despite being deported as alleged members of gangs. Reports from CBS News, Bloomberg, and Cristosal, a human rights defense NGO, have found that a significant portion of the deportees, ranging from 75% to 90%, lacked criminal records. Human Rights Watch also noted that many of the deportees had no criminal history in Venezuela or other Latin American countries."

Furthermore, I have ZERO confidence in this specific government to follow due process and present evidence of actual wrongdoing.

Yes, 100%. Which is how you know none of this will make you any safer. The odds of them finding a gang member harassing the people who are easiest to find is zero. These contractors are hiring police rejects and handing them a quota. That's the whole concept.

When law enforcement tells you to get out of the car, there is no Constitutional right to refuse to obey them and sit in your car thinking your magic window shields you from following the instructions of law enforcement. Not true. ICE does not have the same power as the police.

They need a warrant signed by a judge and not one of their fake pretend warrants.



You do not need a warrant to search a vehicle.

Countries that are dictatorships are usually quite safe. I’ve lived in several. However, they’re not so great on the human rights front. El Salvador is no exception.

Human rights should mean that potential innocent victims do not have to live in fear of violent criminals committing crimes repeatedly..
