The number of people here who don't understand the Fourth Amendment is astounding.
ICE agents can make warrantless arrests if there is PC to believe the arrestee is in violation of US immigration law AND there is PC to believe the person would escape before a warrant could be obtained. But ICE agents cannot enter homes and other private places without a warrant signed by a judge. An arrest warrant signed by a judge authorizes agent to go anywhere, including private homes, where the subject might reasonably be found, but it isn't necessary to effectuate an arrest on the street. Mimms isn't really on point here. Mimms is about a situation where police recover physical evidence as a result of ordering someone out of a car. Law enforcement, including ICE, can use a substantial amount force, including breaking a car window, to conduct a lawful arrest. |
According to the article, ICE visited her home twice before breaking the window of her car to disappear her. In none of the three instances did they have a warrant signed by a judge. The fact they could not get a warrant after the first two times indicates to me they do not have evidence. Indeed, they have not yet presented any evidence she is in a gang. PLUS: ICE kidnapped Kilmar Abrego Garcia. He is likely dead so they have kidnapped and possibly killed at least one person. I hold Trump and ICE responsible for Garcia's fate. |
Trump thinks anyone with a tattoo is in a gang, so I would not pay attention to anything but real and solid evidence that has not been manufactured. They do not have evidence and they have not provided evidence. |

Yes, yes I do think it's quite possible that this woman--and many others--are being picked up by ICE on ZERO, bogus, or flimsy evidence. The Turkish student who was abducted off the street outside Boston is still in a Louisiana prison. She was picked up for co-authoring an op-ed in her college paper that was pro-Palestinian. I'd be happy to link it if you'd like to see it for yourself. It was not "radical" in any way. Regarding the Venezuelans sent to El Salvador: "Many Venezuelans deported to El Salvador have been found to have no criminal record in the United States, despite being deported as alleged members of gangs.
