The (very significant) difference is that the land in the CA case was controlled by the government. If I understand correctly, the Ft. Reno and Chevy Chase cases are all privately owned. The local governments can't easily dispose of the land other than through eminent domain (and ironically, the California case, as well as a host of preexisting caselaw, suggests that the use of eminent domain for these purposes is problematic).

Yes, if you buy a tv on Facebook marketplace that was stolen, you are charged with buying stolen property.

In this case, with title research, the current owners should have known (and it was their responsibility to understand) the title history. They bought stolen property, perpetuated white supremacy, and they should go to jail.

For those of you who are lawyers and don't like the way Blacks were expropriated, we've had a recent situation in fast developing Western Loudoun County. It involves a black community in what became prime real estate, in an especially gorgeous location. Their land was taken from them.

This will not be upheld by the courts in most cases. No one has standing to sue for land that was taken 100+ years ago.

Pretty much all land throughout the world was “stolen” from someone that lived there previously. The Mohawk “stole” land from the the Iroquois. Then the Mohicans “stole” land from the Iroquois. The Europeans “stole” this land from the Mohicans. Everyone is on stolen land if you look far enough back in history. This whole discussion about giving back “stolen” land is absurd because it is a slippery slope with no logical conclusion for who is the rightful owner. There is no better way to destabilize society than to start confiscating land from property owners for to atone for the sins of their ancestors.
