Any promises that would have been material to the plea agreement have to be made part of the agreement. If Flynn might be a witness in a case against someone else, that part of the agreement needs to be discoverable. The question is, did his attorneys have an agreement with the prosecutor not to prosecute Jr., and was it disclosed? |

That's different. Even though he flipped, there is no evidence that he did it in exchange for not prosecuting his son. And, if that was the reason, it should have been in the plea agreement. |
