The punishment doesn't fit the crime here. 61 outrageous conditions for his parole. There's a huge backlash against the law and this judge. In fact, he may withdraw his guilty plea and the trial will start again because the prosecutor lied about the treatment the boy would get. This kid got a living death penalty for consensual sex. It's totally over the top. |
Why should we follow this law to the letter, when laws on adultery that are still on the books in many states aren't followed? |

It does not matter if the 14 year old child misrepresented her age on purpose. It is statutory rape because a legal adult according to the statute had sex with a minor child. The statute says that that constitutes rape. These laws have existed for hundreds of years. They are not new. It is against the law for an adult as defined by the statute to have sex with a minor child as defined by the statute. Most 19 year olds are well aware of these laws and are very careful to stay on the right side of them. It is easy to avoid this crime by not having sex with people you hardly know. |

The point of statutory rape laws is that minors may lie about their age or seemingly give consent, but they cannot because they are not of legal age. Why try to blame a minor child for the actions of an adult? |

It is statutory rape. It is illegal. But the criminal justice system is rightfully becoming more geared toward true rehabilitation. He needed to be found guilty and he needed some sort of punishment. But what was handed down is extremely excessive and doesn't do anyone any good. It defeats the purpose of trying to integrate convicted individuals back into society as productive, law-abiding people. At 19, he would have been much better served with therapy and educational programs teaching him why what he did was wrong, who it hurt, and how not to do it again. But he's not a sex offender in the sense that we all think about. People who have unnatural sexual attraction to children, or people who violently rape or drug people a la Bill Cosby. He was not innocent. But he was not given justice, either. |
Maybe the 14 should be forbidden from all electronics until she is 18, and presumably able to use them responsibly. No computer access, no cell phone, etc.
Right now, she's proven that she is too immature and irresponsible to handle online access. It's too bad there's no court order to "keep her safe" from herself. One that puts it on HER, not someone else. |
This is my post. I have a 14 year old son, and a 14 year old niece. I really do think it would be great to see a court imposed consequence for getting herself in such a situation. If she can't handle the internet responsibly yet, then she shouldn't be allowed to use it. Don't leave the onus on parents who would most likely let up at some point, make it legal. If the laws are about protecting the minor, (and I know they are.. I do realize that) then they need to do that partially with a consequence that suits the time we are in. She would get the message I would think, and perhaps her friends would as well. It is NOT a game. |
Actually, no. He got an outsized punishment for statutory rape. It was not consensual sex. According to the relevant state law, a 14-year-old is incapable of consenting to sex with a 19-year-old. (The 14-year-old may agree, but cannot consent.) |
Again, the problem with this case is that
1) a 19 had sex with a 14 yo. 2) 14 yo lied, said she was 16. 3) 19 yo though he was having sex with a 16 yo. The intent of the law was to criminalize people like me (50 yo) from preying on 15 yo's.... He needs to appeal. this is cruel and unusual punishment. |
That is not true. A 14 yo can consent to sex. But they can only consent to sex with a person that is 4 years older. But the law says that 14 is the legal age to consent. |
