Sure it is, under Supreme Court law regarding college admissions. |
by district court? Maybe, maybe not. |
While I’m sure the school board would be thrilled to get a stay from Judge Hilton, this is really just to tee up a stay motion with the Fourth Circuit. |
Yep. The stay motion here will be denied, and will be even more urgent - and therefore more likely to succeed in the public interest - at the Fourth Circuit. |
DP. I doubt the judge will grant the stay. But I tend to think the appellate court will--at least in some form. But even if it doesn't, the decision is likely to be reversed in part and remanded. It's true that there is a solid liberal majority on the Fourth Circuit, if it comes down to en banc review, but I can see some of the Dem-appointed judges there being concerned about the county's policy. Ultimately, the admissions policy will probably have to be modified in part. The disparate impact is extremely troubling, as is some of the other evidence. But that's just me talking from the position of my policy preference. Others could view the evidence differently. It's unlikely that this ever reaches the Supreme Court. |
Arguments in favor of a stay is strong? How so? You don't let a bank robber get away with robbing a bank just because they've already loaded the money into their car and is not at the moment robbing the bank. The stolen money is the loot. The current admissions decisions are the result of racist policies - they must be redone. |
School Board’s arguments to grant stay for 2026 are extremely disingenuous. Court should ask them to only drop points for experience factors and limits for geographical distribution for 2026. This will not cause them any hardship as they are claiming. |
TJ admissions can also look at SOL, MAP scores as well as courses taken to determine eligible students for TJ for 2026. |
No one is entitled to those seats. They weren't "stolen". ![]() |
They were pilfered. |
They were given to qualified applicants from across the county. Not just a pocket of wealthy middle schools. |
Most wealthy Asian parents don't care about TJ. We can send out kids to private or our kids can't cut it at TJ - either not smart or hard-working enough. They will still do fine. It is the middle-income folks (including Asians) who care. They teach their kids to put their head down and work. And FCPS punished them for it. In the most shameful way. Thank god the judge saw through the racist bullshit. |
The above is the entire point of the new admissions systems. It’s the core. With how the admissions office is apparently allowing ANYONE to get the economically disadvantaged bump due to free meals for all this school year, I worried that this will happen. I saw how those questions were worded and I think any parent could say yes to them. |
TJ is the 2nd wealthiest school in FCPS. Plenty of wealthy parents care deeply about TJ. |
