That works out great until the HOA board members are replaced and the kids are allowed back in the pool. I don't think they would have much of a case, but this HOA has been sued before.

If their ban was reasonable, then it would never have been an issue. But you aren't dealing with reasonable people.

This happens at non-HOA pools too. I used to be on the board at one. If a child or in some cases an adult was violating the rules or caused property damage, we could revoke their membership and ask them to pay fees for damages incurred. This was infrequent but it did happen. There's no way we would have banned a kid for multiple seasons unless there were prior incidents that the family was not willing to address.

The mom mentioned in this piece has a lot of news stories about her. Just google her name and "Virginia." She craves media attention. I think something is off with her, and she seems to be willing to use her children as a means of getting attention.

This. You can also search for her in the online (public) VA courts page. The kid's father too (different last name than the mom, but you can easily find his name when you are google searching her.)

I actually feel kind of bad for the kid that got 7 years. It seems he does not have a strong family/home life and is someone that could actually really use the stability/inclusion of an activity like a neighborhood swim team and pool.

I've seen juveniles commit far more heinous crimes, and get much less serious consequences.
