That works out great until the HOA board members are replaced and the kids are allowed back in the pool. I don't think they would have much of a case, but this HOA has been sued before. If their ban was reasonable, then it would never have been an issue. But you aren't dealing with reasonable people. |
An 11 yr old in October is a 6th grader. They turn 11 in fall - summer of 5th grade. Unless you redshirt. This little shit probably is. He has issues. |

This happens at non-HOA pools too. I used to be on the board at one. If a child or in some cases an adult was violating the rules or caused property damage, we could revoke their membership and ask them to pay fees for damages incurred. This was infrequent but it did happen. There's no way we would have banned a kid for multiple seasons unless there were prior incidents that the family was not willing to address. |

I actually feel kind of bad for the kid that got 7 years. It seems he does not have a strong family/home life and is someone that could actually really use the stability/inclusion of an activity like a neighborhood swim team and pool.
I've seen juveniles commit far more heinous crimes, and get much less serious consequences. |
