HOA pool ban for prior vandalism of HOA property

It is my understanding that Joni Blue, the father of the boy, David Verhagen, and their son that was involved, didn't appear for the HOA hearing with the association to explain their position, plea for forgiveness, and most importantly express any sort of contrition towards this criminal act. It is also my understanding that If you want to find more information out about these parents, go to the Prince William County Court system, and research their names. If you do, you can most certainly imagine that it must be a concern that this boy has no meaningful parental guidance at home, and it isn't my HOA's responsibility to be this child's parent. This family never, ever apologize to the beautiful young man that built this library, nor his family.

Joni Blue has a history of attracting media attention to herself. What parent would want to parade their children around through the media to draw attention to themselves.

The statement that the prosecutors would not prosecute this matter is 100% false. If you understand how the juvenile court system works, then you would understand that a prosecutor doesn't make that decision, the judge does. If the HOA decided to put these boys in the juvenile justice system, then I suspect that the system would ban these boys from the HOA property, similar to a No Trespass Order, and maybe for a longer period of time. Instead, I suspect that the No Trespass Orders were done to keep the boys out of the juvenile court system, but doing all they can to protect the HOA property.

The statements that the HOA abused their authority, and issued punishment are also a very interesting untruths. The only system that can punish anyone is the Court, not an HOA. Also, an HOA can't mandate that a child perform community service, again because they are not the Court. Can you imagine the liability to our HOA should they require underaged children to perform manual labor on HOA property, let alone insurance issues? If the HOA did so, they would expose all of us members to legal liability.

It is my understanding that Joni Blue's son received a No Trespass Notice from the Police Department banning him for 7 years from the HOA property, and I am certain that HOA did so for good reason. It is also my understanding that the Gadbois' son is banned for only 1 year. That difference in the length of time tells you a lot about how our Board is treating this. I do understand from social media posts that the Gadbois did give a letter of apology and did pay the money, unlike Joni Blue. At least the Gadbois seem to understand a little bit, but frankly, missing one pool season for this criminal act, should just be accepted by the family, and turn it into a learning lesson, not a blaming session acting like victims. They should also probably reconsider their association with Joni Blue. I assume that is not helping them in the eyes of the HOA.

I love what I am seeing in our community. There is a lot of positive buzz about our Board bringing the community together. They have our support as they do everything they can to protect us.

Finally, from me any many of us within our community, my sincerest apology to the young man that gave our community such a very, very special gift in Benjamin's Little Library for having to endure what appears to a selfish news media grab.


All you're doing with this story is proving the HOA has it out for the parents.

The HOA member who posted here said that the children do NOT have a prior history of doing anything on HOA grounds. She pretty much said that the HOA banned the boy because they don't like his parents.

I keep seeing “have a history” of ruining HOA property, well then they have more evidence for a case. His parents being sue happy does not make a difference- banning them for this reason is discriminatory. They have to right to file whatever lawsuit they want. The board has no legal grounds to ban them. That needs to come from a court of law


It is clear that you have no idea what the law will or will not allow. Many of us on this forum do understand the law, and your statements are wildly legally deficient! I hope the parents do sue the HOA, because then the HOA will get to speak, but now they are being smart and keeping their mouths shut and not talking to the press, while letting the parents and others take, which gives the HOA a free deposition. "He who speaks first, looses", and I am confident that the parents loose in this matter, especially if they sue. I can see the HOA counter-suing the parents for defamation!!! Then they could own a couple of homes in the association by enforcing the judgment and kick this irresponsible parents out of the community. Based upon what I read, there would be a celebratory party if that happened.

Residents would be much more supportive of the HOA if they actually trusted the HOA. When you consistently display poor judgement and try to throw your weight around, your support quickly goes down the drain. And that "free little library" is actually a glorified birdhouse.


You may not have much luck drawing support from HOA opponents. I’m not a big HOA fan, but this HOA did the right thing by revoking pool privileges of a kid who vandalized.


They didn't just revoke his pool privileges. That is just the main focus now because it is early summer and everyone is excited about the pools being open. They have banned him from the entire community. Literally shunned a CHILD for 7 years. Absolutely despicable. The other area communities ARE talking about them and from what I have seen/heard/read it is not a "good buzz" like the residents of Kingsbrook are feeling.


The kid is a known menace - this wasn't an isolated incident. Sounds very fair.

The people I know in VL think this is fair, and would rather HOAs hold repercussions for this kind of behavior rather than say, door color.


Not a single person has actually provided examples of this child being a "known menace" or any prior incidents. Provide it, please.

Agree. Whoever that person is (presumably a resident of Kingsbrooke?) they sound just as bad as the Kingsbrooke board members. Making false statements about a CHILD, and then throwing members of another HOA (that has absolutely nothing to do with any of this) under the bus by claiming that they all think it's "fair." What awful people.

Is his whole family banned or just the kid? I could see banning the parents as well if they refused to go to the requested meeting and then refused to pay the fine. I think banning for both one year and until the fine is paid is reasonable. Also, a disclaimer could be thrown in that he needs to be under the care of a responsible adult at all times.
