I am a moderate and following this case not because I think this man is innocent but because I am concerned when our executive leadership does not follow our own laws, constitution, supreme court ruling. If you are fine with the executive not following the judiciary, that WILL bite you in the ass when it is a different party in power. It is noteworthy that other than the joke of Fox News, other conservative outlets such as National Review have written articles criticizing the Trump administration on this case.

It is not just Democrats who are concerned, and if you think that, you are not paying attention.


I agree. The lack of due process is appalling. But if we're talking politics, I think it's bad optics for Democratic senators to go to El Salvador and get wrapped up with this guy. He has MS-13 tattooed on his fingers for goodness sake. And he's a wife beater. Republicans are going to town on Democrats once again prioritizing criminals instead of victims. This guy is the wrong hill to die on.


1) it is irrelevant what tattoos he has, the only thing that is relevant is due process

2) the only allegation of Abrego Garcia being in a gang came from one Prince George's County police officer, who was later fired for misconduct

3) If you care about due process, please do not repeat irrelevant and discredited information, that no one in power actually believes to be true. I challenge you to spend five minutes on googling, using only center and conservative-leaning sources that are actually high on reliability scales (in other words, no FOX or less reliable than FOX)

Pretty good synopsis of what has occurred and the fact that El Salvador is not complying with international law to which it is a signatory country.

As Van Hollen said, we would like to have a good economic relationship with El Salvador. I think we hit them where it hurts if they don't return Abrego Garcia. Maryland has lots of people from El Salvador (as does Virginia). We cut off the ability for those people to send remittances back to their families. In about a week they will release Abrego Garcia.

Perhaps, but define due process? It's not clear what that entails. This was a political move by Bukele and helps Trump. Garcia will not be released by Bukele. The order of protection will likely be lifted based on official El Salvador statements that the country is much safer now and there is no risk of harm. The Trump administration will use its executive discretion to justify deportation (whatever the law or regulations allow). An immigration hearing will be held, likely at the US embassy, because Bukele will not allow Garcia to leave the country (and he has no diplomatic status). Remote hearings are allowed under current statute and regulations.

He was seen by two separate courts in 2019 and they agreed he was deportable and not eligible for asylum.

He has had due process. There was an error sending him to El Salvador but to say he didn’t have due process as the illegal he is, is laughable.

All these court documents are online PP. you don’t have to be lied to by Rolling Stone to understand the steps in this case. (For example Garcia wasn’t just seen by the “withholding” judge! This was a process that took many months and an appeals court was involved. And there are arguments that order wasn’t even legal!)

Xinis has no jurisdiction abroad so that’s irrelevant. Any steps involving interaction with another government as the sole purview of the president and not an article 3 issue.

MS 13 is only allowed to hang out with other gang members or recruits and yet Garcia was picked up with them and with a load of cash wearing clothing indicative of the gang IN FRONT of the gang members, and with tattoos. AND there was what the court described as a trusted and reliable informant who had worked with the court before who gave his gang name and rank. All this made it to the appeals court which agreed with the first judge on this issue.

Give it a rest already.

Try to play lawyer and whatever now, fine. A JUDGE ruled that there was no credible evidence he was part of a gang--and yet you and internet warriors argue with someone who was actually provided REAL evidence, and defend unlawful, non evidence based actions of the admin.

He had check ins because he is DEPORTABLE! That’s the whole point. Citizens don’t check in with immigration. He was not permanently authorized to stay and he knew it.
