Wow. It's even worse. Now charged with first degree murder. Seems appropriate.

Wow. I cannot believe he is currently allowed to be at home with his kids.

Kids who are WITNESSES.

Oh hey where is the poster that chided me with assertions that 1st degree murder wouldn’t come into play?

Ha ha!

This former prosecutor has seen a thing or two.

It is accident as manner of death because on the facts assessed by the medical examiner intent is not indicated.

He can still be charged with felony criminal endangering and probably also under the felony murder statutes in Arizona.

If the investigation of law enforcement finds evidence that he specifically intended the death by heat stroke then they can charge him with 1st degree intentional murder.

Etc.

He was initially charged with 2nd degree murder, which does not include intent. A 1st degree charge will not happen.

Oh yes, here you are.

Would you like some sweet tea with your crow?

He seems like a family annihilation risk with the 1st degree murder indictment. Why are 2 little girls who are witnesses against him in the home where they said both parents pressured them to lie to LE?

What is wrong with you? That is your contribution to the thread?

The facts of this case are very unusual. I hope the mother is charged too.

The mother's behavior is incomprehensible.

DP. I think the first degree murder charge may be difficult to convince a jury. Is it warranted, with these new details? Possibly. Is it a slam dunk? No.

The reality is that most parents who bake their kids to death in a car never serve ANY time at all.

This mother got him out of jail and back in the home with the living young kids. Now that their interviews are part of the escalated charges and they said both mom and dad told them to lie, how is that a safe place for them?

To your first sentence, most of those tragedies are noting like this. Read the Gene Weingarten article from WaPo awhile back.

The 2nd part is insane. This article is crazy - he's driving drunk multiple times, with the kids, 138mph, and his wife knew?? And he casually shoplifts beer on top of it all?

I feel so bad for the 16yo per the earlier article, what a deadbeat dad.

A lot of people deliberately choose to leave kids in cars while they shop at Walmart, etc. Sometimes the kids are harmed, sometimes bystanders intervene. Google will come up with many many such stories. Not accidental, change in routine, "forgot" - just don't want to be bothered.

Dude was an antisocial, risk chasing day drinker. Be wary of other parents and carpools.

He was seen on camera in the grocery store and gas station alone, that kid was strapped in the car in the extreme heat for an extended time before she was left in direct sun in the driveway to die a horrific death.

The fact that she begged for him to be released makes her just as despicable, imo.

Why is she defending him? He’s not attractive, and he brings no money to the table. There is no rational reason for her to stand by him (or to have married him in the first place.)

She needs a good nanny and a divorce!
