My guess is that the daughter wants to speak out and feels it empowering to do so.

Wow the sleuth PP who had figured out there was another child and some custody issues was on point.

That poor girl. She’s so young to lose her mother and have a piece of crap for a father. I’m so glad she is out of that situation though and hopefully in time she can find some peace. It would be nice if she could have a relationship with her half sisters someday since they may be her only family. I hope those girls are able to get out of that home as well. My heart breaks for Parker who had such a short life, it must have been a nightmare being left in the car all the time.

Also this goes to show how much of what you see on the surface can be fake. On paper they are this amazing family with a mom with a successful career. Dad is an involved SAHP. Social media spiels about how much their family means to them. Fancy trips. What a sham.

The article says the manner of death is accident. Will that effect whether the charges are dropped or can he still go to trial?

It is accident as manner of death because on the facts assessed by the medical examiner intent is not indicated.

He can still be charged with felony criminal endangering and probably also under the felony murder statutes in Arizona.

If the investigation of law enforcement finds evidence that he specifically intended the death by heat stroke then they can charge him with 1st degree intentional murder.

Intent is not part of the 2nd degree murder charge.

The preliminary hearing was not held, it will go to a grand jury. No idea how that will impact charges/outcome but the proceedings are secret. In contrast, his bond hearing was on YT.

He was initially charged with 2nd degree murder, which does not include intent. A 1st degree charge will not happen.

Not a defense of this guy who I think is a POS no matter what (who forgets about a 2 year old under any circumstance much less after leaving them in a hot car) but I would exercise some caution regarding the story from the half sister. There are a lot of details in that story that point to deep dysfunction in the entire family. Like how did her mom die and why was this guy ever awarded custody of the girl (did the mom have issues that would have led to that custody assignment). Why are the girl and her guardian speaking so openly with a local news station during an active investigation. I would not assume we are getting an accurate explanation of what went on anymore than I'd believe an account from anyone else in this story without some additional corroboration.

This was murder. I live in the Southwest and everyone knows that on triple digit days, not even the AC will cool your car off much, it gets that hot. In AZ you can't even go outside until 10pm at night. Nobody is stupid enough to leave a kid in the car.

That plus the mom's reaction - it's murder. If my H did that to my child, I'd only be begging to get him let out so I could finish him off myself.

This is not some tragic accident or a dad being absent minded. He murdered his daughter. That’s what leaving someone in a car in the summer is.

In this case, yes. But read that Weingarten article from years ago. It’s not always murder and I feel for some of the parents. But in this case, this guy is a POS.
