Trying to rob him wasn't an accident, but yes it was a mistake or error in judgment or poor decision. Perhaps more importantly, it was a mistake or accident if you prefer that the driver got killed. This is very different than two kids setting out to murder someone. Felony murder, where a murder occurs in the course of a less serious crime, is particularly wrong to use against juveniles, where we should look even more to their intent and whether it matches a murder charge. |

No, they weren't bloodthirsty. I've seen no evidence that they had any intent to hurt the driver. In contrast, someone saying a 13-year old's "mistake should cost her her life" absolutely is blood thirsty. |
