It wouldn't be murder - probably manslaughter, but I get your point.

Not felony murder?

Nope. Felony murder.

It’s only felony murder if the underlying offense is a felony. Does the USAO charge carjacking as a felony anymore?

I also remember that Justice Lab were arguing that this very same scenario was justified to not be kidnapping as proposed under RCCA. Just another day DC should be glad for Congressional oversight.

Stealing a car is a felony.

Not one that can form the basis for felony murder in DC. Not all felonies are predicate felonies for felony murder purposes.

Come again? I mean, what?

DP, but DC has a list of felonies that, if there's a death during the commission of that felony, can result in a charge of first degree murder. It's not all felonies. Car theft is not one those felonies nor is car jacking.

Carjacking isn’t on the list, but robbery is. All carjackings are robberies by definition.

Most carjackings are UUV.

100% untrue. You are confusing carjacking with car theft. And this included a kidnapping, which does put the carjacker in line for murder charges.

Kidnapping should be charged and should be used as the predicate felony.

Specifically, UUV is when the police can't prove that the person in the car is the person that stole the car.

Well that wouldn’t apply here.

Why hasn't the name of the woman arrested been released yet. I want to see who this POS is.

You want to see her skin color? Or her age? What difference does it make, she is a murderer void of empathy. One thing is for sure, she is not white or that photo would have been everywhere by now. Sad, but this is the truth.

DC has not released mugshots in decades.

The name should appear in a press release from MPD. My guess is she has a lot of priors that have been no papered or plead down to misdemeanors and also a likely history of failure to appear in court but no warrants executed.

I’m all for blaming stuff on dc government but I don’t really get how this is that unless we find out the woman had a record. This doesn’t sound like kids joyriding, it sounds like a crazy/distressed person from the hospital.

Yeah, the emergency room at WHC is always filled with crazies. I bet this woman was mentally ill and waiting for a bed.

While I see doctors there regularly, I would never go to the emergency room there. I've driven to Georgetown Emergency as well as Holy Cross' emergency room.

Regardless, this is a tragic incident and sounds like it was pretty unavoidable.

This carjacker was a woman.

Then I hope she is prosecuted for murder.

+1 That’s totally felony murder.

It's not a law school exam. Prosecutors are free to down-charge it as is the norm in DC carjackings.

Even prosecutors im DC are starting to realize there's a problem.

I am interested to hear if she is 35, or 25, or 15. And what she is charged with/pleads to.
