There's a difference between theft and robbery. If you take something that belongs to someone else, that's theft. If you take something by force or threat of force, that's robbery, and it's a felony regardless of value. If the kid was assaulted (force) by a part of a group, while other people in the group took his shoes, that's robbery (and a felony) even if all they took a nickel from his pocket. |
But to nitpick but unless the shoes cost >$500 it’s a misdemeanor. The assault and battery with no bodily harm is also a misdemeanor and a juvenile offense literally has no criminal consequences. Actually assaults like these in society come from not educating kids and putting them in the criminal justice system at an early age. Denying them an education will lead them to assault in the future. We educate people for society not for the children. I don’t think the victim should ever see them again and the perps should move. Your reflexive reaction based in your own trauma is delusional. |

Maryland criminal law uses the word "assault" to describe both the common law offenses of assault and battery. I know this because I've been a practicing criminal lawyer in Maryland, not because of Google. That's how I know what robbery is and that it's a felony, too. It's not "picky" to define the offenses properly. Also, if your the other poster talking about $500, that's ALSO wrong. In Maryland felony theft starts at $1,500. Still doesn't matter if you commit a robbery, though. You're very confident for someone who's gotten basically everything wrong. |

Mine too. Instead of SRO, why not reopen Mark Twain school for kids like this and get them out of the high schools. It's disgusting that a kid can't even go to the bathroom without fear of something bad happening. RJ does not work for some kids and esp. when it isn't implemented correctly. I have repeatedly reached out to BOE and MCPS listing some of the huge issues stemming from some kids that are causing fear in students and staff. Ignored. |
