The one against Baldwin isn’t very convincing if, as has been described, it was very common to take the armorer’s or assistant director’s word for a gun being cold in general and on that set. I just don’t see how you get to gross negligence.


I wasn't able to read the NY Times story, but the CBS one I read included this: "In the probable cause statement, the investigator said an FBI analysis found the weapon couldn't fire without the trigger being pressed."

I still say the prosecutor has an uphill battle here. They are going to have an expert testify to this, which, fine. There's what should happen and there's what happened from the perspective of the people that were there, and there's what the jury is going to believe. I find the idea that a jury is going to find Baldwin's conduct reckless beyond a reasonable doubt to be far-fetched.

DP. Obviously AB shot the cinematagrapher himself. But it's hard not to notice how far AB has fallen while involved with someone who lives a fake identity. Certainly his life would be different had they never crossed paths.

Assuming the gun had reached half cocked. On older revolvers, there is a half cocked position that makes the gun "safe." However, that safety is relatively weak and dropping the hammer from before reaching half cocked can fire. Baldwin says he let go of the hammer and the gun discharged. I would hope someone trained him about how to handle antique frearms, but according to the posters on this board, training is optional since all guns are the same and actors just act.

PP here. I think your last sentence hits on something that's probably going to be pivotal i this case. It doesn't appear that there are any overarching, hard and fast guidelines or rules on the training of actors and crew when genuine (as opposed to replica) firearms are on set. This case makes it clear there should be.

So I just think there's a really big hill for the prosecutor to climb unless evidence emerges that Baldwin was trained and warned not to take the actions he took. This wasn't a bunch of friends out target shooting with live ammo.

Baldwin insists he didn’t pull the trigger. Therefore nobody is to blame. The gun shot itself. He refuses to admit he pulled the trigger… therefore he is lying about the basics and for that reason should be put in jail.

Still doesn't make him guilty. Cold gun is a gun empty of ammunition. He could have pulled the trigger a million times without any danger had Halls and the armorer done their jobs.
