I just don’t see how you get to gross negligence.[/quote] I wasn't able to read the NY Times story, but the CBS one I read included this: "In the probable cause statement, the investigator said an FBI analysis found the weapon couldn't fire without the trigger being pressed." I still say the prosecutor has an uphill battle here. They are going to have an expert testify to this, which, fine. There's what should happen and there's what happened from the perspective of the people that were there, and there's what the jury is going to believe. I find the idea that a jury is going to find Baldwin's conduct reckless beyond a reasonable doubt to be far-fetched. [/quote]
