The lawsuit against Royal Caribbean/toddler death

Their ambulance chaser just can’t help himself:

“The family's attorney, Michael Winkleman, called Royal Caribbean's motion to dismiss "baseless and deceptive," and maintained that Anello "never knew there was an open window."

"It is clear that Royal Caribbean's tactic is to blame Chloe's grandfather rather than to accept that Royal Caribbean did not implement industry standards for toddler safety aboard its ships which ultimately led to Chloe's tragic death," Winkleman said in a statement. "Royal Caribbean has premised its defense in this case and its blame on Chloe's grandfather by supplying two deceptive views from its CCTV cameras to the court and the Puerto Rico authorities."

These people collectively need to get a clue. They are only harming their own ability to grieve and heal by trying to make money off this tragedy and deflect the blame.

Yeah, that's my impression too. Definitely hoping for some quick cash to shut up and go away. The defense can't be free for RC.

I think their tactic is dragging this out as long as they can to get better settlement. It's pretty common. Companies usually are afraid of bad PR and give the plaintiff better settlement.

They're playing the chicken game to see who blinks first.

Thankfully RC is not backing down. They’ve had plenty of time to negotiate a settlement and make this go away. Releasing the footage and moving forward with their defense is a good sign that they are not concerned that a few morons may side with the family and no longer opt to cruise with them.

If it was my child, I would want to move on and grieve properly.

With all the legal wrangling going on, the family is not going to be able to move forward & thus heal.

It all was simply a tragic accident.

Yeah, it's probably working out in their favor. First, they get to weed out the idiots who don't have half a brain and can't take responsibility for themselves and want to sue other people for their stupidity, which is good for them. Second, they've clearly got the public on their side, thinking about cruise ships, looking at tours of how big their ships are, etc. They know they will win the case and the publicity is good for them, so they have absolutely no incentive to settle.

I can’t imagine how much I would want the preventable circumstances of my child’s death to be someone else’s fault. It’s all so sad.

Agree. I hope they do not settle/the judge dismisses.

Oh, it’s someone’s fault alright. Just not RCI. Maybe things would work out better if they laid blame where goes, and work toward forgiveness.

That was the case with the woman who threw a toddler off the walkway at Tyson’s years ago. She was mad at her son in law-so she killed his kid (her own granddaughter).

I mean, yes, that will likely be the end of the lawsuit here. And yes, clearly he did lean out. However, it is also extremely likely that he didn't realize he was leaning out. I cannot count the number of times I was zoned out, on autopilot, etc. and didn't realize I had don't something or i forgot something. This is exactly how kids get left in cars. It's possible he was up, enjoying the sun, leaned out and didn't put two-and-two together.

I can already hear the heads explode when some of you read this. And that's fine that you're perfect in that way. You would never do it. It's not at al possible. Blah, blah, blah. But, we all know it is.

No. People leave kids in cars because they are doing something they do every day, and the brain tricks them into thinking they dropped the kid off. In thier mind it happened. It is what happens when your mind goes into automatic mode. This is far different from being unaware that your top half is leaning out of a window. If you truly zone out that much, you should never be allowed to watch children or drive a car. Yes, people make mistakes and we all have moments. But not realizing you are leaning out an open window when holding a child is not normal.


Also-it’s maybe an argument for not putting grandpa in jail, it doesn’t make it RC’s fault. That’s like suing Ford because cars get hot inside.
