The lawsuit against Royal Caribbean/toddler death

Anonymous
Why on earth would he deliberately lean out the window with the baby? Is he insane?
Anonymous
He refused to be tested for BAC. You can draw your own conclusions. Drunk/senile/combo were early guesses. Just awful

However. lying about it and trying for a big payday do not make it better.

"When he arrives at the open window, and while Chloe is on the floor, Mr. Anello leans his upper-torso over the wooden railing and out of the window frame for approximately eight seconds," the cruise line's court motion says. "Because Mr. Anello had himself leaned out the window, he was well aware that the window is open."

"His actions, which no reasonable person could have foreseen, were reckless and irresponsible and the sole reason why Chloe is no longer with her parents," the court motion said.“

I mean, yes, that will likely be the end of the lawsuit here. And yes, clearly he did lean out. However, it is also extremely likely that he didn't realize he was leaning out. I cannot count the number of times I was zoned out, on autopilot, etc. and didn't realize I had don't something or i forgot something. This is exactly how kids get left in cars. It's possible he was up, enjoying the sun, leaned out and didn't put two-and-two together.

I can already hear the heads explode when some of you read this. And that's fine that you're perfect in that way. You would never do it. It's not at al possible. Blah, blah, blah. But, we all know it is.

Extremely likely? Extremely likely? Ok, even going down this ridiculous rabbit hole with you — it still doesn’t make it the cruise line’s fault as the family incredulously claims.

Yeah, those of us who don’t drop toddlers out of windows think we’re “perfect”. Cause that is so damn hard to avoid doing.

Even if he didn’t realize he had leaned out, he had no business lifting a toddler up to walk on a railing not meant to walk on. Falling out a window wasn’t the only potential injury from his actions.

My guess is he had no biological children and thus hasn’t never spent a significant amount of time around kids so doesn’t really understand what is or isn’t appropriate vs stupid. I don’t think it was malicious, just extremely stupid and 100% his fault.

Ultimately none of this matters. What matters is the family claims grandpa didn’t know the window was open and they then sued RC. Video proves otherwise. Their case against RC is done since again, they claimed he didn’t know the window was open.

Exactly. I hope the judge swiftly dismisses the case.

At some point, maybe later than sooner, the family will turn on grandpa. His behavior is inexplicable.

I hear what you're saying and I agree that we all go on autopilot. However, I remember Gene Weingarten making the point that this autopilot happens when one has a set routine. A slight deviation (such as dropping a kid at daycare when the other parent usually does that) isn't enough to safeguard against forgetting. Being on the ship is an aberration -- especially right after embarkation -- and it seems like the adults would have been MORE vigilant in an unfamiliar environment.

That's cute. Without sufficient experience and training, we can't expect fully grown adults to know that an open window on the 11th story presents a significant hazard even to inanimate objects?

I hope too.

And I also hope RC sues the family. And every single person on that ship that had their vacation disrupted/tainted sues.

After knowing a baby just fell to her death off the ship could you really just merrily go about the rest of your vacation? Of course not! Every single person on that ship was a victim of that man's negligence!

Autopilot when doing your morning commute and forgetting a baby in your car is very different from dropping a kid out a window.

I’ve been on that ship and looked out those windows on deck 11. There’s no way he didn’t realize the window was open and what he did was obviously dangerous.

No. People leave kids in cars because they are doing something they do every day, and the brain tricks them into thinking they dropped the kid off. In thier mind it happened. It is what happens when your mind goes into automatic mode. This is far different from being unaware that your top half is leaning out of a window. If you truly zone out that much, you should never be allowed to watch children or drive a car. Yes, people make mistakes and we all have moments. But not realizing you are leaning out an open window when holding a child is not normal.
