This is part of the job description for the H-1B position that @Mizzou posted online. The claim that H-1B visas are only for highly specialized talent that no qualified American can fill is clearly a lie.

Any of my friends and colleagues could do this job. Anyone 2 years out of college, even 1 year out. A smart American young adult of any ethnicity, of any background, so long as they’ve proved themselves a bit in college, could be easily trained to do this job.

(2-3 years out could figure it out with little to no training, one year out might have to be monitored, hand holding for 3-6 months)

H1b is basically ethnically choosing who this will be. Down to 1-3 countries of origin. That is wrong. Full stop.

Missouri is a red state, isn’t it? Can OP answer why the Republicans there are letting this happen?

I’m op of the thread and I’m not sure wtf you’re talking about. But this is not a Dem or Rep issue. Both sides suck on this issue.

You’re stupid. The GOP is the one currently in power. Why are you harping about Democrats?

Huh? Where am I harping? You don’t seem to understand that there are many people on this thread.

And so many people are so thick or immigrants themselves so they don’t know the history

We know republicans are evil and lie and will support big business over workers

The tragedy is that democrats used to be our party. They were the party of labor only a generation back. But they have abandoned workers and become just like republicans.

So when people say that republicans are in power so they should repeal these programs, you are missing the forest for the trees

Democrats claim that they are the party of workers, then act like it, and do what your parent democrats would have done. Stop these visa programs used by big business to replace our own children with cheaper foreign labor.

THIS Republicans stink but Dems have done nothing for workers either. I won’t vote Dem again unless they are an unabashed progressive

They were also the party of slavery. IMO they never really came clean on exploitation. Especially the Northern Democrats who were financing exploitation around the world for many years after the civil war. My read is the whole "civil rights" for "immigrants" (Landmark legislation were passed in the same year) exchange was nothing more than a way to drive a wedge in the American working class.

public universities are exempt from H1B limits

but not exempt from fraud.

A university spokesperson, Christopher Ave, told local broadcaster, ABC 17 News, that the university is looking into the matter.

“The university attempts to hire U.S. citizens and permanent residents through competitive recruiting processes. On occasion, the university hires highly qualified individuals that require an H-1B visa,” Ave reportedly said. “The university follows the federal rules and regulations in petitioning for these visas, including making the required postings.

On the rare occasions that we request these visas, they are for highly specialized positions for which a doctorate or master’s degree is required. For these positions, we exhaust our efforts to hire a qualified U.S. individual. After we file the petition, the federal government will determine if the application is accepted.”

The Justice Department’s Immigrant and Employee Rights Section (IER) enforces the anti-discrimination provision of the Immigration and Nationality Act, which prohibits citizenship status and national origin discrimination, unfair documentary practices in employment verification, and retaliation, according to the agency website.

The agency encourages workers who believe they have faced such discrimination to file complaints through its hotline or website.

for a 64K communications employee.

typical crap you get from anyone supporting H1B and OPT and L1 visas

and remember this is how these entities "exhaust our efforts to hire qualified US individual"

Hiding job postings on hidden sites separate from the main job sites. Both Apple in 2023 and Facebook in 2021 had similar patterns of behavior during PERM labor market tests:

  • They did not list postings on their websites (unlike other non-PERM roles)
They required applications by postal mail only
They did not follow the same recruiting processes as for normal open roles

  • As a result of these unusual practices, very few or no Americans noticed or successfully applied for PERM roles.

    https://www.newsweek.com/h1b-jobs-now-american-workers-green-cards-2041404

and here is classic video of lawyers talking about how they dont want to hire US workers during PERM process. all of this is legal and not a single Democrat is helping to stop it or reform it.

Immigration attorneys from Cohen & Grigsby explains how they assist employers in running classified ads with the goal of NOT finding any qualified applicants, and the steps they go through to disqualify even the most qualified Americans in order to secure green cards for H-1b workers. See what Bush and Congress really mean by a "shortage of skilled U.S. workers." Microsoft, Oracle, Hewlett-Packard, and thousands of other companies are running fake ads in Sunday newspapers across the country each week.

“Our goal is clearly NOT to find a qualified U.S. worker…our objective is to get this person a green card…so certainly we are not going to find a place where applicants would be most numerous.”

Reform to the employment-based immigration system is long overdue, a couple of simple reforms that Democrats could do that would make the party of labor again:

H-1B: Add a labor market test requirement for this visa, to ensure that companies consider Americans first for all jobs in America. Additionally, we believe companies should pay an extra ongoing payroll tax for each H1B they employ, to avoid any cost arbitrage of hiring lower-paid foreign workers.

PERM: Labor market tests should be reformed to require posting all ads on the companies main career website, accept applications digitally via this same website, and have their ordinary recruiting staff review applications according to the same process as all other hiring. Companies should also be required to post open roles on mainstream online job boards like Linkedin or Indeed, and consider applicants for equivalent roles for open PERM labor market tests.

OPT: The statutory STEM OPT visa program that allows graduating foreign students 3 years to work without another visa should be cancelled immediately and entirely, as it unfairly allows foreign students to take entry level jobs that American citizens graduating from college could fill.

I just want to point out that many of these kinds of initiatives can be addressed at the state level if the Democrats truly wanted to broadcast their intentions. They could easily require foreign labor LCA be published in widely used websites.

I would like to see Republicans do more, like Texas and Florida. I mean their government backed h-1bs are at least a start and they very clearly stated their position through policy.

There is no legal requirement for an employer to first search for a qualified American worker before sponsoring an H-1B visa.

Universities have the additional benefit of being exempt from the annual H-1B cap. As a result, they are given every incentive to hire H-1B workers over Americans because H-1Bs provide significant cost savings.

The U.S. Department of Justice filed a complaint on April 28, 2026, against Cloudera, accusing the company of a sham recruitment process from March 2024 to January 2025. For roles like Senior Staff Engineer paying up to $294,000, U.S. applicants emailed a dedicated address that bounced their submissions, yet

Cloudera claimed no qualified Americans applied to sponsor H-1B workers for green cards. Assistant Attorney General Harmeet K. Dhillon called it discrimination against U.S. workers, part of a relaunched initiative that has secured 10 settlements; Cloudera denies wrongdoing. The case seeks penalties, back pay, and an end to the practices amid broader H-1B debates.

In Cogniznt defense, folks in US don’t understand that having corporate leadership comprised of a vellalar, a jatt, and two goltis is the Indian equivalent of having two black guys, a white guy, and a latino. This is as diverse as it gets. forget hiring US citizens, never going to happen.

So you let Republicans win and tear down the NLRB and reduce minimum wage and healthcare. Smart!
