Uh, no it hasn't. Literal quote from Charlie Smith, Frederick County State's Attorney "he plan is still to charge the 15-year-old and the 16-year-old as juveniles"

"Fifteen-year-olds in the state of Maryland do not get charged as adults for even second-degree murder, they have to be 16," Smith said.

"Spitting on someone is not a hate crime, Maryland law is extremely specific about what constitutes a hate crime," he went on to say. "It has to be based upon someone's race, national origin, ethnicity, sexual orientation, religion or age or disability or homelessness... right now what we know is that it was over a dollar bill, it wasn't over race."

Detectives are still investigating the matter, however.

"If the facts warrant the charge of a hate crime, we'll charge it," Smith said. "If they don't, then we're not going to try to chase something that doesn't exist."

Well most kids do not associate with the bad kids who make life hell for everybody. I'm sure that the average teens would LIKE to go to a fair and have fun w/o worrying about what will happen if they can't fork over a dollar to some lowlife street thug.

Definitely agree that most teens aren't like the assailants but from the tone of previous posters who no doubt echo the sentiments of many people Frederick, I don't think most black teens will be given the benefit of the doubt. Not a reach to say they all will be viewed with suspicion and resentment.

And I just read an article stating Smith’s office is investigating getting a waiver to have them tried as adults. Yes, they are automatically charged as juveniles. That’s how it should be. There needs to be thought and consideration when charging minors has adults.

I don't think that's fair at all. There have been one or two posters who are trying VERY hard to make this all a racial thing. People are plain sick of that. The kids who did this are just BAD kids, period. Crime like this is completely unacceptable in a peaceful community. People are not as black/white stupid as some posters like to think they are.
