NP. Because he was operating with reckless disregard for others. It is not likely that punching a person once would result in death. Now if the person is 100 years old, maybe murder would be a possible charge.

And some people survive being shot in the head or strangled or having their throats slashed. But in this case the man was punched in the head HARD and he died...so that is murder. Not attempted murder, but murder.

You can not argue that these boys did not "mean" to hurt that man very badly. And when you intend to hurt someone very badly and they die from their injuries you are guilty of their murder.

The fact that it was all filmed proves that it was a premeditated attack. They should be charged appropriately. The girl who filmed it should also be charged as an accessory. I'm not a lawyer but if what happened on The Accused is actually legally sound then you could say that she actively participated in the attack by encouraging it and she should thereby also be punished for the crime to the full extent of the law.
