Well, if that is the case, you shouldn't have any problems with a college only accepting white (or whatever) kids if they think that allows them to better accomplish their goals.

Private businesses under public accommodation laws are unable to do this.

Sure they can but don't kid yourself that diversity helps these schools to accomplish their goals. This social engineering nonsense is all in the name of political correctness, not academic achievement. Having some quota of under-qualified URMs doesn't magically enhance the learning environment or outcomes, quite the opposite.

Really? Literally every.single.piece. of literature I’ve ever read on affirmative action defines this process as the promotion of members of groups who have previously suffered discrimination. That’s literally the definition of affirmative action. You’re wrong.

NP - and although I agree with you, that's not the legal rationale that will pass muster today. In college admissions the only lawful rationale is "diversity" for it's educational value to the student body and the institution.

Remember, we are talking about race criteria in college admissions decisions, not governmental-driven affirmative action. They are different. Almost no one does their homework enough to understand the distinction, and you are among those.

Not sure what you mean here. Are you saying we need diversity in qualifications, some book smart, some street smart, etc. because high stats is not all that? Surely the book smart kids can pick up on things or two from kids from the school of hard knocks, party goers... You know, the ones that value Beach Week at Ocean City after a night of debauchery... They, too, can become the next president, the senator, the supreme court justice...
