NP - and although I agree with you, that's not the legal rationale that will pass muster today. In college admissions the only lawful rationale is "diversity" for it's educational value to the student body and the institution. [/quote]

well the rub is the "racial" part, what with the equal protection clause and all.
Publics generally cannot use race as a factor in admissions. Privates can.[/quote]
