Verdict Wednesday!

Issues with this:
- The defense went to trial without knowing the underlying crime the prosecution was charging - very unconstitutional.
- The instruction that the jury does not have to agree on what happened and can choose from a menu of options - ridiculous.
- The fact that one of the crimes is a federal election crime is egregious. Bragg has no authority here. If it were a Democrat being prosecuted, you know damn well that Garland would jump on this and prevent them from prosecuting a federal law. Just look at how they have treated Texas and OK when it comes to immigration law.

This has been a sham case with an apparently corrupt judge and a corrupt DA.
Hopefully the jury will see this trial for what it is.... an attempt to eliminate a presidential nominee from election.

Defense argued the above stuff in its omnibus motion to dismiss back in September. Merchan order allowing the trial to proceed was issued in Feb. Seems like your questions are addresses here: https://www.nycourts.gov/LegacyPDFS/press/PDFs/People-v-DonaldTrump2-15-24Decision.pdf There was a 4th possible object crime in connection with McDougal, but the judge did throw out that one as a permissible theory of the crime.

If convicted, I'm sure these will form the basis for appeal.

I wondered about the jury not being allowed a copy of the instructions. This is apparently a New York thing, in other states juries can be given written instructions.

If Bragg has no authority here how would Garland have authority to prevent the prosecution? You contradict yourself.

You are incorrect. There is a good reason why Trump needs to stay there. If the jury sends notes back to the court with requests. The court has to be called back into session. And then the judge will read the note for the two sides and there may need to be discussion to address or respond to the jury. Both sides must be present for the reading and response to jury requests. And the defendant must be present for the reading in case there is anything the defendant wants to pass on to his lawyers in response. NY state law requires the defendant to be present when the court is in session to hear everything that goes on in his case.

Therefore, the judge has said that Trump may move freely within the building, but must remain in the building. Apparently, there is a room across the hall from the courtroom where Trump and his team have been retreating to, when court is not in session.

Why, is Trump special? What the judge required is normal. How far is Trump’s home? Sometimes judges tell them to be within ten minutes of the courthouse; thus allowing them to go to nearby eateries.

Hung jury-they'll announce before the weekend. The jury doesn't want to spend another weekend dealing with this.

Only if being an arrogant con artist from queens is special.

Lawfare, oh the drama...Trump being treated like the criminal defendant he is. Why are you so committed to defending the bad guys? You're so partisan that you're willing to sell out?

To MAGA idiots, law and order means that powerful people get to do whatever they want, and everyone else is treated like criminals no matter what we do.

That’s literally why they say “law and order” instead of “rule of law.” “Law and order” means “against who, when we say” whereas “rule of law” says the law should be applied equally to all.

Which is why they think Trump should be given a special dispensation to sit at his home in comfort.

If they come back today or tomorrow and say they are hung, the judge will send them back to keep trying into next week. So that won't help them.

All of this.

The idea that the jury doesn’t have to agree on the underlying “crime” is absolutely preposterous. The idea that one of the them is a federal crime for which he was never charged is also outrageous. The idea that no co conspirator is named - the idiocy here goes on and on. And you don’t have to be a Trump voter to acknowledge it.

I love seeing this string of posts that try to inflame and confuse.

This is not hard.

These are not obscure or archane laws.

And there has to be unanimity around the conspiracy, but not the individual elements of the applicable laws.

That is standard in NY law.

Or are you saying that the law should be applied to Trump differently?

They already did away with the statute of limitations just for Trump.

No, under NY Law, a felony is treated differently than a misdemeanor.

Nothing was done BECAUSE of Trump. Stop with the victimhood.

I just pray that the holdout can hold on through tons of peer pressure as he resists conviction. He just needs to think about all the benefits that will come to him for defending Our President.

Sounds on brand. Trump even learned how to record the payment this time.
