I think Totenberg has made a misstep here. I don't think she made this up, but used some very vague language in her report. IMO, she needs to be careful about preserving her record and legacy. She was a close personal friend of Ruth Bader Ginsburg and Ginsburg's husband. But she's practically an American institution on Supreme Court reporting. The public pushback from the Court is a sign to knock it off. |

It was all in good fun back when that yearbook was published, but the humor soured once a fascist-loving president awarded Gorsuch the Supreme Court nomination after McConnell robbed Obama of the confirmation process for the same opening. And later, a bunch of Trump-loving fascists attempted a coup. |

Still, unlike the fake news about Justice Sotomayor dining out without a mask that was pushed in conservative media ten days ago, the “blue check” crowd has yet to demand retractions, nor have there been any soul-searching articles about gullibility or confirmation bias, nor any scolding of NPR or Totenberg. NPR and Totenberg, meanwhile, still stand by the debunked report. It appears they will hang their refusal to take the Justices at their word on the sole reasoning that Totenberg used the words “in some form” when writing that Roberts “asked the other justices to mask up.” Nevertheless, the original and still uncorrected report from Totenberg says definitively that Roberts asked. Roberts says definitively that he did not. The Court asks that attorneys wear masks that cover the nose and mouth at all times within the Court building, except when actively eating or drinking.
