Because employees were not being given the information or time needed to make informed decisions. Case in point— sometime after I logged off last night, they added a “this is subject to appropriations” clause. Which changes a lot. People should have information up front. It should be truthful (ie, we might not get the money), it should give time to consult with a financial planner and attorney, they shouldn’t keep changing the terms, they shouldn't make promises that, objectively and legally, they might not be able to keep.

Follow the process, give people good info, only offer what you know you can legally provide, stop the high pressure sales techniques and very short deadlines and then sure— FORK AWAY. As it stands, people counting on VERA in late summer might have their resignations effective 3/14 because no funds were appropriated. And lose VERA, which they would have gotten without FORK. That is one of 1000 risks that should have been disclosed.

Wow, so instead of letting people take the deal, they are forcing everyone to be fired. Sad. You know they will set the bar high and expect everyone to be in 5 days a week. My relative was looking forward to the 8 months paid admin leave and then retiring. Now they will need just to retire immediately. Hopefully its just a pause but if it does get blocked It feels like they stole a great deal from a lot of people.

PS: But there is still time to blow a whistle, to recognize the error of their ways and make a deal giving evidence. That could be spun into a real redemption arc.

This offer is only open for a few more days, though, and unlike Ole Musky, this time that deadline is real. Tick tock.

BECAUSE IT'S NOT LEGAL, and therefore it exposes anyone who takes the offer with not actually following through on all the promises made, such as being allowed to stay home as soon as you hit send; being allowed to not work until September while still getting paid; guaranteed salary until September. Also, depending on the agency, the offer conflicts with specific agency rules.

It's a huge risk to take for a private individual. The language of some of the Fork emails stated that once accepted, the employee waived all rights to complain later. Some emails said that actual work might be required of some employees, in person. And indeed, some IRS employees who took the offer found out that the IRS still required them to work until May! I believe this was used as an example in the lawsuit, but I may be wrong.

Unions are doing their jobs and protecting their members from exploitative labor practices.

Again, a federal RIF comes with benefits, severance and protections. And in many cases more money than the FORK. Very few people can just be fired. They need to go through RIF procedures. I know they aren’t right now, but that’s next weeks lawsuit. RIF is in a statute, passed by Congress. It’s a real thing people can depend on and does not require you to sign away all rights. In almost all cases, RIF is better than FORK.
