It's Virginia Law.
It's CDC recommendations.
It's over when people stop getting sick and hospitalized at high rates. No one can fully assure when that is of if and when there will be another variant. I'm in support of metrics for assess when or when not we should use different public health measures (e.g., I supported the decision in the summer when numbers were low that masks were not needed among vaccinated people and I support the decision now that they are--because the numbers of cases and hospitalizations are very high).
People don't get to choose whether or not to wear a seatbelt--it's the law because it protects them and protects society from the burden of having to provide them healthcare in accidents. Protective actions that slow transmission of contagious disease are even more understandable.

I’m bringing to think he has crappy legal counsel and a weak grasp on government 101.

The view is that state law requires districts to follow those recommendations to the greatest extent practicable. So if it is a recommendation (ex masking) they are supposed to follow it.

The CDC as an organization makes recommendation, and requires very little; but masks are listed as a mitigation strategy so per SB1303 “maximum extend possible” it still stands.

It’s not your decision, it’s FCPS. If you want to remove the mandate, contact the SB, the superintendent…or sue. Your sole choices are limited to public education, private education, or homeschool. If you CHOOSE public, then you follow their rules.
