If he does not go and if it is not settled in some other way, he is liable to be extradited if he goes to any other country that has an extradition agreement with Brazil.
I guess he should just stay in the US and he won't have to worry about dealing with Brazilians and having a cocked gun aimed at his head! He could just claim diminished mental capacity and based on his interactions he may be believed. The guy is just plain dumb. |
Do other countries extradite for misdemeanors? The US doesn't, but I don't know enough about extradition laws in other countries. |

I don't know the answer but I suspect that it varies by country. Of course, Brazil could just say he is wanted on a felony charge and another country may well accept it. The guy is so fucking stupid to risk everything with a cockamamie story. |

No, this story where just about every SINGLE thing he said was a lie or an exaggeration: "We got pulled over, in the taxi, and these guys came out with a badge, a police badge, no lights, no nothing just a police badge and they pulled us over," Lochte said. "They pulled out their guns, they told the other swimmers to get down on the ground — they got down on the ground. I refused, I was like we didn't do anything wrong, so — I'm not getting down on the ground. "And then the guy pulled out his gun, he cocked it, put it to my forehead and he said, 'Get down,' and I put my hands up, I was like 'whatever.' He took our money, he took my wallet — he left my cell phone, he left my credentials". About the only thing that may be accurate is the "whatever" since that is about the level of his intellectual discourse. |

Huh. According to the follow up police reports, the being pulled over in the taxi was true. The guys having a badge or some form of ID was true. The swimmers now knowing who those people were initially (no lights, no nothing) was true. Pulling out guns was true. Telling the swimmers to get down was true... So the part you have issue with is him saying they put the gun to his forehead? That part right there? *that* is what you considered to be the whole of the story? I don't know about you, but I imagine if I have a gun pointed anywhere near me, especially if I'm drunk, it's going to feel awfully close and when I'm telling the story - not giving a deposition or filling out a criminal complaint, but telling the story - I might tell it from an emotional rather than entirely factual perspective and a gun that was 3 feet away might be right at my forehead. But that, that single detail, is the one that causes you the most pain? Huh. |
His name in the international community? This is a 32-year-old swimmer that barely anybody overseas not associated with FINA had heard of or cared about prior to last week. They'll forget him again soon enough. It would be so stupid to return to Brazil at this point that I don't think even Ryan Lochte would do it. Their courts somehow took five years to return Sean Goldman despite being Hague Convention signatories, who knows what nonsense they might cook up? And there's no way he'll be extradited. |

According to the NY Times, the Brazilian police have recommended charges, but the prosecutors have yet to decide whether to bring them. Let's hope the prosecutor is smarter than the police and lets this ridiculous episode go:

It makes no difference whether the US is willing to extradite Lochte. It will prevent Lochte from traveling to any country that has an extradition treaty with Brazil because he may face a demand that another country who may be less reluctant to extradite him to comply with Brazil's demand.
Lochte will be best off to work out what is tantamount to a plea bargain with the Brazilian authorities if the prosecutor decides to accept the Brazilian police's recommendation. He really does not want this sword hanging over his head ready to drop at any moment. |
I think he's fine ignoring all of this IF he is done swimming. Presumably he isn't done -- bc otherwise why is he getting a sponsorship from the cough drop company? If he isn't done swimming, he needs the ability to travel internationally bc swimming championships happen all over the world and that's how they keep up with the competition during the off years so that they are competitive for Olympic trials and the Olympics. World championships this year are in Canada; in Hungary in 2017; in China in 2018; and in South Korea in 2019 followed by the 2020 Games in Japan. Though if I were him I wouldn't be heading back to Brazil to deal with this -- there's a good chance they throw him in jail just to show the world they can. Can't part of the plea bargain be -- we will settle with you/pay fines/do community service if required but we will do it thru the Brazilian consulate in the U.S. -- we are not stepping foot in Brazil?? |
I agree with your comments for the most part. The problem with ignoring the potential danger he faces even if he is done with competitive swimming is that if he travels to any country, even as a tourist, he could be faced with extradition. My understanding is that if he is charged and convicted in absentia in Brazil, he will then be on Interpol's radar as someone who is wanted as a fugitive and that alerts countries as to his criminal status. I am sure that with the right legal counsel in Brazil something can be worked out that settles this matter which is really in his best interests. My point was really that extradition from the US is just one part of the equation and refusal by the US to extradite him does not mean he avoids future legal jeopardy. |
I agree with you -- IF he's done with swimming AND willing not to leave the US even for vacations, then he's in the clear. Otherwise I think he needs to find a way to clear it up bc he risks being dragged out of a hotel someplace whether he's checked in for a competition or whether he's there to party on the beach. |
