If you are in the left lane and not actively passing and no one is behind you, that is a violation. If the person behind you is doing 80, you are still in violation for travelling in the left lane.

You would get a ticket for blocking the left lane. It would be open and shut. You are not actively passing and in the left lane. That the car behind you is speeding is not a defense to the left lane issue. If there was no one behind you -- you could not be in the left lane if not actively passing. Indeed that is where most of the tickets for this violation come from. People like you driving the speed limit in the left lane. Trooper pulls up behind you and it is an easy ticket. You just do not get to be in that lane in Virginia unless actively passing.


Not true. In the DMV the left lane is basically always faster than the right lane, so you are indeed continually passing even when "just" going at the speed limit. Take your reckless road rage somewhere else.

No, the right lane is the default lane. You start there. If you need to pass someone, you do it quickly, and then move back over.

Why? The right lane is often going 10-20 below the speed limit, so of course I will be in the left lane.

This does not happen unless traffic is very heavy, which is not the situation we’re discussing at all.

DP here. In most (all?) states, using the left lane not to pass is considered aggressive driving, punishable by fines.
