You are not actively passing and in the left lane. That the car behind you is speeding is not a defense to the left lane issue. If there was no one behind you -- you could not be in the left lane if not actively passing. Indeed that is where most of the tickets for this violation come from. People like you driving the speed limit in the left lane. Trooper pulls up behind you and it is an easy ticket. In the DMV the left lane is basically always faster than the right lane, so you are indeed continually passing even when "just" going at the speed limit.
