There was some incident with the GF at an airport where someone grabbed someone else's arm but the girlfriend has come out and strenuously said that the incident has been mischaracterized

Yeah. I thought Depp called them as witnesses. It would be strange for her to call them and basically say she cheated on Depp with these guys and even on Depp’s own property but then they say she’s cool and not crazy.

Franco is supposedly testifying that he saw her with bruises in the building, nothing to do with a relationship between them

Didn't this psychologist say that his attorneys contacted her to do the eval? Why would Heard have to submit to an eval from Depp's selected expert? It's her burden to establish the PTSD in a counterclaim. Then Depp could have a counter expert challenging the opinion of her expert. But how do you get a party in a civil case to do in-person evals with your own expert?


I would be very surprised if they don’t have an expert of their own. But I don’t know the particulars of how this went down.

I am not sure of what went down during the pretrial stage, but there is a Discovery Rule in Virginia that permits the court to order, even over objection, an independent medical exam (which includes a mental health evaluation if that is what at issue) by a professional selected by the other party. So, while I am not sure that this happened, if Amber Heard put her own mental at issue by making claims of PTSD or what have you, then the other side had the right to request that she undergo a mental health examination with a doctor of their choosing. See below:

Order for Examination. When the mental or physical condition (including the blood group) of a party, or of a person in the custody or under the legal control of a party, is in controversy, the court in which the action is pending, upon motion of an adverse party, may order the party to submit to a physical or mental examination by one or more health care providers, as defined in § 8.01-581.1, employed by the moving party or to produce for examination the person in the party's custody or legal control. The order may be made only on motion for good cause shown and upon notice to the person to be examined and to all parties, must specify the time, place, manner, conditions, and scope of the examination and the person or persons by whom it is to be made, and must fix the time for filing the report and furnishing the copies.

So Depp's attys said this psychologist was going to issue a number of damaging opinions (that Heard was lying about having suffered domestic abuse or lying that Depp abused Heard, etc) that she never arrives at or testifies to.

Any comment that isn't dripping with sympathy for Depp is labeled a pro Amber spin.

He has nothing, he lost a defamation suit in the UK. It is much easier to win defamation suits there. It is extremely hard to win them here, especially against public figures. There is almost no chance he prevails.

What's odd to me is that Heard and her lawyers would have agreed for Heard to be evaluated by their expert.

I am PP above who said I thought this psych's testimony was damaging to AH and wondering if a psych was going to testify similarly about him. So it's interesting to me what the negatives of this psych's testimony are; evens things out a little. Cross is not completely decimating this witness, but is making the dinner with drinks at his house as an "interview" look a little unprofessional and fangirl-y.

I am arguing with my teenage daughter trying to get her to see how unfair it is to blame everything on Amber. DD and her friends think Amber is to blame for ruining his illustrious career while I believe he did that in his own. Amber’s career and reputation has been savaged as well. DD tells me that the internet is siding with Johnny.

The world wants a villain (preferably female), while shared culpability, pesky details and nuance just get get in the way of one sided story telling.


I disagree. We are only now hearing Depp’s side of things while Amber’s take has been out there for over 5 years. This is the first time people really got the opportunity to compare what went on in that relationship from both Amber and Jonny’s perspective.

AT BEST he is a drunken drug addict who left the mother of his children to date a hot crazy chick in her 20s and engaged in a mutually abusive relationship with her. I don't think she is the victim she claims to be. It would have been better for both if they had just divorced quietly.


Same here. They are two toxic people who were very toxic together. Both were abusive. Both are guilty. There's no winner in this scenario.

Yes you can, especially when you're talking about being in a cycle of domestic violence and not trying to win any legal argument, which is what she was doing in the op ed. Many abusers are also/were also abused. Being a victim of abuse makes you statistically more likely to abuse in fact. Isn't this your all's defense of him? That he abused in response to abuse and therefore he is the primary victim?


She has no moral high ground here is my point. He might lose this case (likely) because of the legal standard that he is probably not going to meet, but it doesn't mean that she was a victim any more than he was. I don't view all women who cry DM as credible. Facts still matter.

Yeah, facts matter, as you will find if you sue someone for defamation -- you will need to prove that they lied in order to win.

Nice use of the passive voice. Who exactly is doing the labelling? If you mean me, that's incorrect, as this is the first comment of the sort that I've made. If you mean some imaginary pro-Depp horde that you envision taking over this thread, that sounds about right.

And please keep making the same point about your thoughts on the relative difficulty of winning a defamation suit in different countries. I'm worried that someone will miss it if it isn't on every single page
